Further reading on the DEFRA site after a nice chat with some PCSO's this afternoon, if you get caught somewhere its not up to them to prove that you're not allowed there:
"The burden of proving that there are public vehicular rights of way rests with the defendant. The prosecution does not have to show that there are no vehicular rights." linky
And it would seem they can give you a £30 fixed penalty if they so choose, as well as the official warning on the first offence.
"A constable must not seize a motor vehicle in the exercise
of the powers conferred on him by section 59 unless (a)
he has warned the person appearing to him to be the
person whose use falls within section 59 that he will seize
it if that use continues or is repeated, and (b) it appears
to him that the use has continued or been repeated after
the warning. However, such a warning need not be given if the circumstances make it impracticable (and in certain
other limited circumstances)."
Moral of the story is when someone notices police approaching and suggest that now would be a good time to fuck off out the area, it probably is a very good time. |

Ste your bang on ,im totally legal and frown upon anyone who isnt ,but.......................i for one would not stand and argue my rights with these twunts,there is no point ,rev up and jog on,save yourself the hassle ,they sit at easy to get to stops anyway ,they have not the means or the bottle to chase you back down a trail ____________________ CRF230 all you need |
