So after a lovely weekend in wales I hugged Becky and left for home from her house, joined the M6 at junction 13 which is currently covered by SPECS (can't get bikes) so I do 50 in the 40, soon as it hits NSL I get up to about 100.

I spent the next 5 miles at 90 to 100mph using any lane that was open to make progress at my pace, used lane 1 for an extended period to under take a huge line of cars sitting in the middle lane for no reason then weave back through to lane 3 and so on.

I approach a section just before junction 14 where the police like to sit so I slow to about 80, go past and there's nothing about so I get back up to 100 in the middle lane. I look in my mirrors and there's a police volvo just catching me with its blues on, glance over my shoulder and he points at me. Neutral

I pull over and we're joined by another police volvo, I step off the bike and one of the coppers is already standing next to me and asking me to get in the back of the car. Turns out they were a few cars behind me when I joined the motorway and I just didn't notice them, they'd been chasing me for 5 miles when "you did speeds of 90 to 100mph" and of course they'd seen my use of lanes as well. He also accused me of using the hard shoulder to over take which I told him I didn't.

I was cautioned and told to expect something in the post as they're doing me for driving without due care and attention but he never mentioned whether he was doing me for speeding or not and at no point gave a specific speed they'd caught me at. Confused

So, I know I've fucked up big time and chances are they're going to take my license and eat my first born child but I have a couple of questions.

1. I wasn't asked if I wanted to view video footage, should I of been?

2. Since he never mentioned a specific speed, are they likely to do me for speeding as well?

This is not a thread for people to tell me I'm getting what I deserve etc, I know I messed up and deserve whatever punishment they give me, I will look back on this and laugh one day, just not now...

So, anyone up for a rideout next year?

Did you get a court date from the last thing yet?!

They will have to say something like "I am reporting you for the offence of blah".

I think they'd also do you for one or the other. So I suspect it'll be due care rather than speeding, although I'm sure it'll be mentioned for considering in the due care thing.

They may call you in for an interview under caution (I had to have one).

Not sure evidence-wise.

Due care is a max of 9 points. So your licence shouldn't be in too much danger. Time to buy a new suit and get your story straight.

There's an amazing forum for this kind of thing that I used when I had due care problems. Something like traffic-laws.co.uk I'm sure someone will correct me, but search for it.

They can definitely fill in the blanks.

I wouldn't say you deserve it. 100mph on the motorway is nothing, and even a bit of undertaking can safe if you use your noggin.

You just did what most of us do everyday but got unlucky.

Unlucky mate, Ive just been reading this over on VD. Good luck with this, I'm not really sure what penalty driving without due care and attention incurrs.

Those middle lane hogger piss me off god damn, Although I try very hard not to undertake at all, some times despite how much flashing and waving your hand they never budge! Twisted Evil

Very simular to what happened to me, except i was caught with an average speed of 107mph over a mile or so.

I pleaded guilty, went dressed in a shirt and tie, they asked me my reasons for doing so, i explained about my ill mum and that i need transport for work etc. Said somthing along the lines of thinking back i know i shouldnt of done such hazardos manouvers on public roads and felt deep guilt over doing so.

Came away with a 49 day ban (over 56 and you have to re-take tests...) 0 points (still in my first 2 years, and already had a SP30) £200 fine and a CD10 (driving without due care) and a 2nd SP30.

My insurance was still £400 cheaper than last year Laughing

Gaz is right.

First you have to sit and wait for the next 2-6 months for a summons to come through.

Once you've got it find a decent solicitors and book an appointment, your first hour is free and you can fill the legal aid stuff in there. They will probably advise you as to what to do (vaguely)

Once you've qualified for legal aid you can go back and sort it out. If you do go with Stevens (5 mins from you anyways) you wont have to go to the court date in the summons as the solicitors will represent you, they are a huge firm and work in teams so there is always someone available to you at court/station or in the office.

Anyway enough blabbering, wait to see what you get first, but definitely get legal advice.

Oh and to answer your questions.

1. It doesn't matter at this stage really.
2. Probably not.

Depends what comes with the careless.

I got legal aid for custodial, and for care and attention along with 2 fail to stop offences and 2 bald tyres - neither of which are custodial. Both entirely different incidents.

Unlucky mate. I was doing the same thing on the same motorway just in the opposite direction. they will do you for the greater offence ( the due care ). Just take it on the chin but make sure they have crossed their "Ts" and dotted their " i s " make them work for your license. Oh and get some propper advice.

I'd refute the claim that you undertook in the hard shoulder if you didn't do it. I can see that going against you real fast. Way faster than the speeds you got busted at anyway.

Is it just SPECS cameras that cannot track bikes, or do others suffer a similar flaw? I ride along the A2 a fair bit and that is littered with 50mph average speed limits which tend to get fairly frustrating after 10 miles or so.

A guy i know got caught for the same(ish) 2 years ago. I was with him at the time. Basically doing an average 90 - 100 he went from the outside lane to the slip road to get off at J12 southbound. (He admitted later that he didnt even check his mirrors). They pulled us over and showed him the video evidence. They said they were doing him for dangerous driving and not the speeding as the dd carried a heavier penalty. He never heard another thing, so got away with it. In his case that really wasnt a good thing because he drives like a complete dick and is going to kill someone unless they get him off the road.

Have you been asked for a producer? He wasnt.

As far as I know yes, the ones on the M6 read the front number plate which obviously bikes don't have.

Andrea, sadly I think having the police chase you for 5 miles whilst you switch lanes all the time is a bit worse than cutting across all lanes to exit the motorway. Wink

For what it's worth, the CPS (Crown Prosecution Service) normally only goes for the most serious offence - if you were driving without due care and attention and speeding, it's likely that they'll just do you for the former.

If you do get a ban, you won't get points - points are effectively fractions of a ban, which is why you normally lose your licence when you get to twelve points. A ban is equal to twelve points in one go, so once you're banned you start with a clean sheet again.

Rear observation is a good thing - which I know is closing the door after the horse's gone - but I'm sure you won't make that mistake again.

Oh, and speeding in roadworks is not a good idea. Anyone doing it doesn't deserve to be on the road IMO. I've worked on various fast roads with nothing but a few plastic cones and a yellow coat to protect me from tossers who think they're too important to slow down. Every year there quite a few road-workers who get mown down and killed by out of control vehicles. It's not nice. Crying or Very sad Please don't do it... Thank you.

For what it's worth the road works weren't in progress, they do all the work over night but the speed limit is there during the day as well.

Last time I down graded to a CBR400 I got caught speeding.Sad To be honest, regardless of what bike I was on I would've been riding the same, a CBR4 will easily hold 90 to 100 for extended periods of time just the FZR is easier to nip between cars on because of it's massive horse power.

Most annoying thing is there's nothing I can do until I get a court date, I just want to get it sorted now!
