What have I missed Very Happy

If anybody of you are friends with me on Facebook you may know the result already.

I was VERY VERY lucky, In the end I got a caution and a section 59, The inspector said it was definate jail time if he'd have decided to prosecute for Dangerous Driving after he watched the video's. He was very leniant with myself and Jase and I can't thank him enough. it bode well against me that I'd got a full time job, no criminal record, clean driving licence, and that i was utterly remorseful for what I'd done and who it had affected. Apparently he'd seen the thread I'd made saying how depressed I was and me asking for my accounts to be removed because I couldn't take it anymore. Last he saw he said the last thread was up to 18 pages long.

I've got all the evidence back, and it was a LOT that they took.

I owe him a massive thankyou, and to PC lafferty too, He's a very down to earth copper who patroles the Cat n Fiddle road, I've offered to buy him a coffee if/when I see him up the fiddle.

To cap it all off, I've learned my lesson, well and truly, and I'm sure this lesson has also hit the biking community with regards to their riding on public roads and video'ing it.

Hopefully I can get my life back on track and settle down a bit.

Anywho, I'm back, What did I miss?

I so have the vids now I have the PC back, But i'll be keeping them to myself.

And when I said evidence, I meant PC, monitor, printer, all memory sticks, all hard drives, printer, leathers gloves, helmets, boots, cameras, photo's, posters, absolutely anything to do with bikes or PC.

A caution and an S59. What a monumental waste of time and money. But slightly less a waste than would have been suffered with a full prosecution I guess.

It'snice to know that there are coppers out there (on in the case of the inspector 'in there') who can recognize when someone is sincerely contrite and remorseful and make a sound decision.
In your case, it looks like he has recognized from your postings a genuine shift in your attitude since getting arrested, and the extra sobering effect it's had on your immediate online community and decided that more good can come from capitalizing on that and sending out a message than putting you in the dock and taking your bike, license and/or liberty. I'm sure that the next person who gets caught in the same way is going to feel the full weight of the law because the police won't want to be seen to getting soft on such a political hot-topic, so others better be warned!

In any case, you've been lucky beyond measure, but I think you already know that. Have a nice Christmas Wink

That is lucky mate. Hope you get back in to the normal routine again and get on with your life.

What have you missed,? Not much.. from memory: There was someone quoting a kid from another forum who had covered his radiator of his 125 "wi a bit o cardboard" and was wondering why the temp was rocketing up... that's all I remember Very Happy

Take it easy and yeah as above, get some trackdays!

Great news, that makes me feel a lot better about humanity knowing that you weren't prosecuted for something as borderline as that.

However, It does seriously bring in to question the necessity of raiding your house at 7am so they can caution you and give you a section 59.

I'd like to see the chief constable justify his actions in that without squirming. I'd also like to see you talk to a solicitor about that and see if there is any recourse you can take. I'm fairly sure it won't happen because I'm sure you want to just put it all behind you, but still... 8 coppers removing YOUR posessions for an offence which didn't even go to court. People say we live in a facist state, and we don't, but it is events like this, and police like those who decided to perform the raid that make people believe that we do.

Great news, and a good result for common sense, but I think this is definitely a case of the ends not justifying the means in any way. Even if you were a crazed maniac, which you clearly aren't. It may well be the caution and the section 59 were a face saving measure when they realised they couldn't actually prosecute you for anything. It makes me sick.

If not, I'm dumbfounded. Not saying that you should have been punished, but if you haven't, in this country, with our legislation, with the current profile of video uploading offences etc it must be a million to one shot.

Police Reform Act 2002 Section 59 - Vehicles used in manner causing alarm, distress or annoyance. Aka a "Bike Asbo". Crappy piece of legislation.

Sounds an awful lot like they made a cock up along the way and found it they couldn't actually pin you with anything.

+ Saw that you were remorseful so gave you a s59.



IMO you should have got points, 6 maybe and a fine. Maybe banned for a year or something but they seemed to take into account job and clean license so fair enough.

Raiding your house and arresting you at 7am is totally not necessary. That's is why I think the above.

Glad you got off a potential jail sentence which could really ruin your life.


If I was a copper looking at this and it was upto me and I didn't know you off BCF Laughing then points and a fine would be my idea of a fair punishment.
