Hi
Anyone know any good simple online resources for this. As far as I understand it people have to take a minimum half hour lunch break after doing so many hours. What I need to know is whether this is backed by legislation and if so and someone does not take lunches who receives the penalty and what the penalty is.

The law is a 15minute break for every 4hours worked and a 12hour break between shifts, as far as I know.

Yeah I'm sure you had to have a break after four hours of work, but I'm not positive. It may have changed
Check out www.hse.gov.uk. This is who regulates all this stuff. As for penalties, well in theory the Health And Safety Executive can shut the place down till they comply with their regulations although I'm sure this never actually happens.
You might have a hard time searching for this subject on the website. You would be better off giving them a bell. There will be an local office near you.

According to my work, you need to have 1 x 30 minute lunch break per every 4 hours that you work.
So, I work 10/11 hours a day, so have to have 1 hours lunch.
Whether or not you actually do it is different, but that's what the law states as far as I know!
It's annoying too as I don't get paid lunch breaks, and don't always go on lunch if I'm particularly busy! ____________________ Current Toys: Honda Africa Twin for road & touring | Yamaha WR426 for the muddy stuff and enduros

Nah then they just tell me "well it was your choice to work through your lunch, not our problem!"
I just try not to work through lunch if I can, and spend plenty of time checking forums during working time anyway so if anything, working through lunch isn't all that bad.
I don't do it often anyway.
My aim for 2004 is to 1) get a decent bike 2) quit work and find something better and 3 ) get a trail bike

That's only if your hours span over lunch time.
If you work 2pm - 6pm then you do not get any break. ____________________ Honda Bros 400

I work 9am - 5.30, I get a paid 30 min break.. is that enough? My last job was the same hours, but you were entitled to 30 min lunch and 2 x 15 min breaks, but I've no idea about what we are legally entitled to  ____________________ First: Honda NSR125 (2001)

Yeah basically you are entitled to 30 minutes break every 4 hours not per every 4 hours. ( I think it's six now )
Though lots of places give longer breaks, they don't actually have to.

At Sainsbury's, you get nothing for 4 hours, 20 minutes for 6 hours (whether it's over lunch or not) and one 30min paid break with 1 hour unpaid lunch. ____________________ Honda Bros 400

| I work 9 - 5 usually and have to take a 30 min lunch break, which isn't paid (I rarely take the lunch break but still have sign out and back in, as if I had). By law they have to make you take a 30 min lunch break but they don't have to pay you for it. 30 minutes minumum for lunch. 20 mins break for every 5 hours worked (which is paid for). |

Hi
Looking at this it looks like you are entitled to a 20 minute break if you are working more than 6 hours. However you employer is not bound to ensure you take that break, just to make sure you have the option to take the break.
There doesn't seem to be anything in there about people being paid for their breaks, and to be honest I do not know anyone who is officially paid for their lunch break (never have been in any of the companies I have worked for in IT).

In the company I work for I am a weekly paid employee, but there are also monthly paid staff, all of which get 1 hours paid lunch.
I think this is just at the companies discretion, I'm sure they don't have to.
My GF used to work for a company that let her take up to 2 hours paid lunch break , whats that all about ____________________ Make poverty history - Eat the homeless.

I've read someware that you can work for 5 and 3/4 hours with out a brake. But if your shift is longer you must have at least one 15min paid brake.
But plenty of people tell me i should only work a max of 4 without one.

The law (as mentioned above several times already) is that for 6 hours work you get 20 minutes break. ____________________ BCF: Be yourself, just don't be an arse.
