Just curious really, personally i don't drink really, certainly go nowhere near a bike when i have... But your pillion? say they were technicaly over the driveing limit though completely co-herent, would this be a problem? if so who would be responsible (who would take the rap?) If they were obviously obliterted and held on with bunges and gaffa tape then there would be problems...

I wouldn't take a pillion if they were drunk. If they made one false move you could kill them and yourself or injure yourself and them pretty badly.

I am sure they could get the pillion for something, but not being the rider and not incharge of the motor vehicle I don't know. Maybe the rider would get the rap?

The police don't have the powers to breathalyzer the pillion (or passenger in a car) unless they suspect they were riding/ driving at the time of the offence.

So there is nothing illegal about someone being pillion who is drunk, think as the rider if they cause a crash or similar then your insurance is liable.

A guy at work has a bandit 12 and he gave his mate a lift to work (hes a ZX6R man) after zx6r had been out the night before. So in the morning when he picked up for first shift he was a little bit tipsy. Bandit let him on the back all the same, all went well until a junction when it became apparent that zx6r was no longer happy just sitting there and decided to take over the leaning duties. Took a wee bit of 'counter leaning' to stop his elbow scraping around a junction he said! Rolling Eyes

Although its not illegal to carry an intoxicated passenger you can I believe be charged with carrying an unsafe load.

Its the drivers resposability to ensure all loads are fixed securly and all people are suitable for travel. A drunk pillion isnt suitable for travel.

Ive done pillion tipsy a fair few times. provided the person riding isnt going fast nor riding agressivly and your still easily sober enough to walk then i can't see the harm in it.

I've been pillion on a cb4 while hammered a few times. Not so drunk i couldn't walk, but drunk enough to talk utter shite to everyone.

I knew the dangers and it was a strange floaty feeling. Much better than being sober as i was much more relaxed.

Not strictly true, any person who has been involved in an accident and who is "suspected" of being the driver/rider may be given a breath test regardless of whether they have consumed alcohol or not, and any person who commits a moving traffic offence may be given a breath test if it is suspected that alcohol has been consumed, and the key is a moving traffic offence.

Although a pillion passenger on a bike may be legally carried whilst drunk, then if that person causes a crash and the rider carried that person on the back knowing so, then the insurance will not pay out, and best case scenario is that if they did not know they were drunk, but it was shown that they were intoxicated, then the value of any claim will be reduced by at least 25%
