.....and who may have points on their provisional.

If you get any more points then any previous points on your licence still 'valid' count towards the maximum 6 points allowed under the New Drivers Act 1995.

I've just had my licence revoked (i.e. thrown in the bin) by the DVLA after being caught out like this.

In my case I had six points on my provisional licence from 18 months ago, just before I passed my test in fact. Last month I got caught allegedly doing 88mph in a 70 and received 3 points, bumping my 'points since test pass total' to 9 points instead of the 3 I thought. Because I passed my test less than 2 years before this I've lost my licence.

So remember, they can use any previous points that are still on your licence to nab you.

Confused Life sucketh huh.

AFAIK, unless it's something really bad (like drink driving) then they stay on for 4 years... I'm looking forward to a shiny clean licence next year Smile

They only stay valid for 3 years, but you have to wait 4 years until you can have then removed. No Idea why though.

Afraid so Stryker. I had my bike license for 13 years before taking my car test last summer, only to be informed upon passing that the 3 points I already had from the bike (before I even thought about learning to drive) actually count towards my 6 point limit. Basically it was 'congratulations you've passed, now you're 3 points off losing you license...... Gits.

No, It only applies if it is your first full licence since your provisional.

Once I've sold the bike. I'm going to the bikeshop I bought the bike from to see if I can swap it for another cheaper bike + tests etc. Here's hoping huh.

Damn, I'm not sure now. The way I just read that is I'm at risk like anyone else who has passed their test since 1997. Or is it because I passed my car test before 1997 this does not count to me?

I ask because I have 3 points on my license. They are due to expire but still it freaks me out.

Interesting. The guy who passed me informed me that the rule applied to me and that the points I already had counted towards it. Then when I approached the DSA about it they confimed what my examiner said. I'll have to look into this further, perhaps I've just spent all year riding like a complete poof for no reason.

Your not at risk at all, you have held your full licence longer than two years, the New Drivers Act is ONLY for people who have passed there first test coming from a provisional in the first 2 years.

If you were 45 years old and had just passed your first test then you would still be still governed under this law, age has nothing what-so-ever to do with it.

I think its confusing and dubious. (The rule, not your explanation Craig).

I was told (by the guys in the theory test centre) that if I got 6 points between passing my bike test and two years then it would be bye-bye license. And I've been driving a car for 10 years prior to that.

The way I saw it was that its for anyone who has passed a test. Which means that it's meant to slow you down for a couple of years once you've passed. Which would make sense, I guess.

I suppose the trick is to slow down for a couple of years and get the probabtion period out of the way!

Well I have just been on the phone to the DVLA, and spoke to a lovely friendly woman who also confirmed that it only applies to your first test pass, so if thats your motorcycle test if in the first 2 years you get 6 points you licence is revoked, however if you held a full car licence (or vice versa) before then and have held it more than 2 years the Act doesn't affect you.

Hopefully that will clear up the confusion, also sorry for taking this thread a tad off topic. Smile

That is correct, it applies to your LICENCE and not your categories.

After all, the points aren't noted down as to which vehicle you gained them on.

Hi

Ouch. Sorry to hear about that.

To be honest if you can manage to afford it then I would see if you can pay a local training centre a small amount for a lesson and bike hire. This way you do not have to sell your bike.

Is your theory test still valid? If so get your test in quickly (saves the cost of another theory test).

Also you mention getting caught for alledgedly speeding? Do you mean that it has not gone through yet? If so can you opt for court and delay the points beyond the 2 year cut off point (not sure if this is possible). If you could delay the court case by 6 months your might get away with it.

When you repass the test for one licence category you get all the ones you lost back. As such if you took a car test you might get your bike licence from that test. I think Zimma investigated this so he might well be able to tell you for certain, but if this is correct then it might well be worthwhile.

So just to clarify, you had 6 points on your provisional, passed your test, get 3 more points, lost your licence.

Did you think the 6 points would be thrown out once you got a full licence then?
