Just got a court date through and need a solicitor to give me advice on what to do....plead guilty, pay the money and see what they give in points or see if its worth fighting.

Driving without due care and attention is the charge.....I supposedly overtook and ambulance on a dual carriageway in broad daylight, didnt get in their way (as per their statement) and they reported me.

Bit of a silly thing to do, if i did it, I know. But since when have ambo's been the upholder of whats right on the road....and take the time to note down my number when attending a heart attack????

Definitely get a solicitorand don't go in with the white flag waving, that sounds like a very shaky prosecution. How can ambulance drivers be qualified to decide what driving without due care and attention is? Unless you held them up when they were on an emergency call, which you clearly didn't since you were overtaking, I can't figure out how it was even brought to court.

I know within the City of London Ambulance drivers and Firemen have the same powers as a serving Police officer, not sure if this applies beyond the Griffins but I believe it does.

Absolutely the whole story!!! They said a black motorcycle flew past (mines red/white/blue 01 rry blade), they didnt see the number plate, caught up with a bike sitting behind a car at a roundabout and took my plate!! Honest...bible and all!!

Spoke to about 5 solicitors today...all knobheads except one....he said " I'll use an old law phrase.....fuck em!"...he's my man

There used to be a firm of solicitors who advertised in some of the bike mags - the firm was called 'Wright - Hassall'.
Whatever were they thinking?

WHat type of road were you on?

I've overtaken ambulances/fire engines on dual carriage ways/motorways before as they have no hope in hell of hitting 70mph even with blues'n'two's going.

What are other motorists supposed to do, slow down to 50 and stick behind them?

It's possible they wanted to change into the outside lane but saw you coming up quickly so felt they couldn't because of you, that would qualify as obstructing them. However I wasn't aware you could get reported by the ambulance, althought I believe if 2 independant members of the public report a motorist for something it can be used as evidence, and maybe 2 ambulance staff in one vehicle qualify as independant.

I thought it was you cant overtake an emergency vehicle if it has its blues n twos or whatever on as you could obscruct it reaching its destination.
My friend got done years ago for overtaking a fire engine going up a hill in sheffield as the fire engine was going very slow as the hill is very steep., he was in his car getting bored so overtook it, and got done. simple.

what ive found, quoting bits out of the highway code

Arrow Situations needing extra care

29: Emergency vehicles. If an ambulance, fire engine, police or other emergency vehicle approaches using flashing blue lights, headlights and/or sirens, keep off the road.


Arrow Other vehicles
194: Emergency vehicles. You should look and listen for ambulances, fire engines, police or other emergency vehicles using flashing blue, red or green lights, headlights or sirens. When one approaches do not panic. Consider the route of the emergency vehicle and take appropriate action to let it pass. If necessary, pull to the side of the road and stop, but do not endanger other road users


Arrow 255: Warning signs or flashing lights. If you see or hear emergency vehicles in the distance be aware there may be an accident ahead

I cant find anything about it being against the law but you never know,

Does their statement say they watched you continuously until you came to a stop and then took your number plate? If it doesnt, they cant prove that the overtaking vehicle didnt turn off leaving you sitting at the lights innocently on your own.

Sounds like a load of old shit to me. Ambulance staff on a power trip anyone?

I personally wouldn't bother with solicitors, didn't when I was done for speeding. In my opinion, they can kinda be an admission of guilt if you're going to contest it, if you're so sure you were in the right, why would you need a solicitor. However that's just how I see it, magistrates may not see it the same.

With your case though, the ambulance said they saw a black bike speed past them, then caught up later with a r/w/b one, so it seems impossible for a conviction to come out of that. I think the solicitor would just end up costing you more than the conviction if you even got one. I had quotes of £1000 for representation by a solicitor for a simple speeding case, ridiculous.

Ambulances with people with spinal injuries travel very slowly, they can of couse be overtaken if safe to do so.

Hi,

Not heard good thinkgs about the keepondriving mentioned above I have heard they take the 100 quid to join and then say you need a solictor (from them) at approx 2000-3000 a case .

It was bound to happen. You dont get one over on the establishment that many times without someone noticing.
If the cps take this case on They'll make sure it sticks or they're going to look stupid.

Thanks for the response guys......

Cest, not being funny, but dont think its a good idea to post the evidence word for word on a public forum.

I've got myself a solictor and Im going to fight it, dont think it was me and theres enough holes in the evidence to have a go at. Its going to cost me an arm and a leg, £600 for the initial report and representation to the cps to try and drop the case before court and £1000-1500 to go to court.
