Ok heres the story.

Sold a car way back in January, and sent of the V5 etc like a good boy with all the details of the new owner and that was it.

Untill a month ago I get a letter telling me I had failed to declare the vehicle SORN or re tax it, and as such I owed them some money.

So reading the letter I did as it said and informed them that I had sold the vehicle, again supplying the name and address of the new owner.

I get a letter from them thanking for the new information and to ignore any other letters,
Then a few weeks later I get another letter again demanding money off me, even though I had sold the vehicle my failure to notify them of the change of new owner meant I still owed them money!

It turns out the thing that started all this off was the fact that the tax had been cashed in on the vehicle a few months after I sold it by the new owner (which is in a totally different town 200 miles away from where I live), and the vehicle then wasn't sorn or anything by them.

I again today have had a nice letter telling me they wish to take it to court unless I pay the £80 to them. Now for some reason I think they should go do one, anyone any suggestions on what to do - apart from pay as this is just a principle thing now.

Ring them up and tell them about the letter they sent saying ignore all other letters sent and quote the reference number on it. Should sort it, it did for me when I scrapped my car and they tried to do the same to me.

They tried to do the same thing to me. About 2 years after i sold my bike and filled all their forms in they where sending me tax fines and telling me it was in my name still. I filled out their form again! guess what months later it still wasnt out of my name and i didnt even have a clue who had it after that. Lucky I wast taken to court after about the 3rd attempt and much rudeness on phone they never contacted me again. Rolling Eyes

dvla are daft
a friend had a car scrapped
he has had letters from dvla demanding money as if its still on the road, but their own website has told him it has actually been recorded as scrapped

he has now sent them a screen print of something which is on their own web site

this same thing happened to me ,cashed tax in and sent disc away on form and declared that the car was on a sorn, this info is on the same bloody form as tax disc, get cheque back for 40 odd quid and 3 months later i now get a demand for £40 because i haven't declared car off the road and am being threatened with £80 fine or a day in court ffs.

i've now got to phone on monday and try to convince them that i've put the car on a sorn already Rolling Eyes

wish i could be as f00king usless as theDVLA and not get the sack Evil or Very Mad

Thank you very much, someones getting a letter as Im sick of the gits.

Orrrrrr do I just ignore them all and wait till they take me to court and ask them to produce all the information from when the tax was cashed in etc. Laughing Im in the mood for a good argument at the mo.

DVLA are a bunch of arseholes, you can do everything in your power to make sure all your paperwork etc is in order and they'll still f#ck you over because they're incompetant.

I was given a CB250 about a year ago, non runner, had no tax and was apparently declared sorn. I checked when I got the V5 back in my name, and was told on the phone that because the vehicle hadn't been taxed since SORN came into force I didn't need to declare it SORN or re-declare it each year, unless I taxed it, then it'd be subject to the same rules as everything else.

Last month I checked all my vehciles as a routine on DVLA website (I have a few vehicles offroad), and the CB250 came up as unlicenced, I rang them and was told it'd been untaxed/Unsorned for a year and I should declare and will possibly get a fine. I was furious as expected but they say nothing they can do and I should've SORN'd it when I got it... Rolling Eyes I would've if they hadn't told me not to. If I get a fine i'll take it to court, happily.

I was fined £80 a few years ago, my VFR was burnt to a crisp, obviously including the tax disc on it. I never recieved a tax reminder in post, next thing was an £80 fine, I rang to complain and was told there was no option to appeal, fascist tossers.

Hi

DVLA are a waste of space.

We got hit for a fine earlier in the year for a car that was sold for scrap and we cashed in the tax disk.

They were informed that it was scraped but because we never received a letter from them to say this they said we are still liable.

And cashing the tax disk in does not count as declaring it SORN (despite the form deliberatly telling you not to declare it SORN if it is sold and you are claiming the tax back).

Trouble is that it is not a fine. It is a charge and enforced through a CCJ. So basically you can only go to court and argue about the debt, not about the DVLA incompetance. And most people do not want to risk totally screwing up their credit history for the sake to taking the DVLA on.

Not sure what the solution is. Beyond disolving the DVLA.

Well I have totally ignored a total of four SORN fines and nothing has ever come of it.

Rather than take you to court, they now farm out the "debts" to private sherrifs officers/ballif companies who send a series of highly misleading and threatning yet essentially meaningless letters. After a while they give up and send the matter back to the DVLA who as far as I can see, then do nothing.

This has happened with the last two I got.

You have now ignored all our previous correspondance to this very serious matter. We now have no alternative than to report back to our client and inform you of our recommendations to them to take the following actions:

* The registered vehicle should be clamped.
* A CCJ should be persued through the civil court process against the vehicle keeper.

To prevent this action you must contact us immediately on: **** this file will only remain open with us for the next 14 days.


Takes about 10 months from the initial 'fine' for this to come through.

Hi

You are lucky. I got a summons to a small claims court miles away.

Although if you have the time and money I suspect there is a way round it. As they are not a court they cannot issue a fine, merely a penalty charge same as a bank issues for being overdrawn. As such I suspect the same legislation applies that the charge must be reasonable and merely be to cover their costs. So an £80 charge for not renewing a £15 tax disk is excessive.

Earler this year I got a 'fine' for the fact that my Discovery did not have an MOT. I rang them up and they said I hadn't MOT'd it! I then ask them who was the Registered Keeper...the call handler (I am being polite) said the car was stolen on 7th August and not recovered. So I explained to him, in a calm manner, that as I do not physically have the car how can I MOT it? He reluctantly agreed!

I wasn't aware you could be fined for not MOTing a vehicle. Are you sure you don't mean tax?

The MOT on my bike expired in may. I've not recieved anything telling me about it. Vosa deal with mots, not the dvla. I've never heard of em contacting people. There loads of reasons why a vehicle hasn't been mot'd.

Tell them to sod off and update their records instead of pestering you.

Did the same with me, i sold my vehicle, sent all the relevant forms off bought another bike etc, gets a letter off the DVLA telling me to tax my bike or SORN it, so i send them another letter back telling them ive sold the bike, sent the forms off etc. Getting confirmation saying thanks we've updated our records.

Few months later i get the " We want £80 for not taxing or SORN'ing your bike" send another letter saying its been sold sent the forms off blah blah.

Month later i have a court summons, i go to court with all the letters ive sent saying ive sold my bike, and the court took 5 mins to come to the conclusion that the DVLA are pissing me about, and they will not be persuing me for any money, however i was asked what costs id incured today, and got a days wages and fuel costs off the DVLA.

The moral of the story is, the DVLA are ineptual bastards who are out to rob you.
