Would this be attempted copyright theft of a Sanctuary Records product?

Well a friend of my sister's boyfriend recently had a letter from paramount pictures saying that he had downloaded one of their films and he has three days to respond. He's in very deep smegola indeed. Turns out that the movie/record companies are hosting a load of downbloadable films and then when you download them they nail you. They're doing it on all peer to peer networks apparently. Scary stuff!

Sounds like entrapment to me, but it sounds as if we should all be extra careful with KaZaa.

I thought it was also an offence to be offering them for download? So if he downloaded something and it turned out not to be the film then he is OK. If he downloaded it and it was the film, then that's thier own stupid fault for offering it to him for free Smile

I wonder quite what they are expecting him to reply with? "Yes I did, but it was a poor quality rip, and the sound wasn't quite in sync. If you have a look on vcdq as well, then many other people feel the same way. Sort it out Paramount" Smile

Yeah I though that too Ste, but at the same time, they own the copyright so they can offer it for download.

It wasn't one of their current catalogue AFAIK.

The way I thought about it was they could host it on a peer to peer network 'cos they own the copyright but if you download it then you are breaking the law...

I suppose he could write back saying that he laready owns the DVD and he was downloading it as a backup copy... not sure if it will wash though.

US courts have recently (last couple of days) ruled that the methods the US labels are using to prosecute people aren't legal, and Kazaa just won their court case too. Very Happy

The major labels do partake in some interesting tactics to stop downloading tho - not doing anything against people on a legal basis, just lots of spoofing and seeding the networks with funny files that clog up the p2p networks.
