Right people, anybody who read up about my off will know what happened.

Basically, I came off my bike and don't believe it was my fault. I sustained very minor injuries but my reason for wanting compensation is the fact that my bike is trashed at the moment and I really don't think it was my fault.

I went back to the road and there are bits of stone and dirt on the road, plus the road surface is shocking. Apparently I can claim from the council under certain conditions for the damage caused to my bike. I've been browsing through claims sites and nealr yall of them apply to personal injury. Could somebody point me in the right direction please?

Cheers peeps.

Hi

If there is a warning sign then you are going to have major problems claiming. And, basically, they are only liable if they know about the problem and have not taken any steps to correct it in a reasonable time.

All the best

Keith

Defo no warning signs. The road is in a poor condition and like I said there were bits of stone and gravel on it, which apparently the council are obliged to clean road at certain intervals.

I'm gonna try https://www.nowinnofeeclaims.com/ and see what they say. Can't hurt can it?

Just phoned them and they said they were personal injury claims as well. They recommended going to speak to the Citizens Advice Bureau. So that's where I'm off to after work.

Hi

Depends on how much the road is used as to how often they are expected to clear it (or look at it).

All the best

Keith

Hi

Trouble there is that you know the road and so should have known to take care.

All the best

Yeah but you can't see the poor condition of it until your standing on top of them. From a car you'd never notice them

I can still see what you're saying though which is a fair point.

As already said by Keith, unless there has been a report that that stretch is dangerous then your struggling. Sounds like your the only one to have an accident there, if there were more then there would be a record of it.

Is it an A road or B road, well used or quiet?

One reason to get used to your local council website and get reporting all that dangerous stuff on the roads.
Then in cases like this there is a chance....
Reported loads of spills on the roads. Not that i've seen any action on them, but at least i know if i see a shunt i can advise them its been reported Thumbs Up

Sadly its to much of, someone else will do it.... Twisted Evil

If the no win no fee people say that you should go the CAB then they are basically saying you haven't got a hope in hell of getting anyhting out of the council.

It's something to do with if the council had already been informed about the problem but nothing had been done in a reasonable time window.

How long ago was your crash? Did you get photos of the road? What type of road is it (main A road, single carriage way country lane, etc etc)? Did police attend the crash?

You've been on the road for over 2 years, you knew the road was in poor condition, you fell of the bike yourself. But you want to sue the council?

This is going to be like the American society before you know it where people sue each other all day long of the smallest of matters. It was your own fault you fell, no one elses mate. Let it slip. Thumbs Up

A B-road and it's fairly well used.

They only said that because they only deal with personal injuries.

Basically I have photos of the road and there are bits of gravel and stone scattered round where I crashed and the road itself has little pits in it where water would sit. I know some people think I'm just doing this for money but I'm not.

Funnily enough, the police drove by and didn't stop. Why the hell do we pay taxes and stuff just for them not to do their job? And why do we pay road tax when roads are in poor condition?

As has already been said, if the road hasn't been reported before then you have no chance of getting compensation.

Please don't take this the wrong way but in my opinion you should take responsibility for your own mistake. You're the one riding the bike, you should be looking at the surface and adjust your riding to suit.

How much gravel are we talking? Posting your pics would make everything much clearer. If it was a well used B road then there'd only be debris in the gutter or in the middle of the tyre tyre paths. And it kinda asks the question why you rode through the gravel....

if theres no-one else involved, it is near enough ALWAYS your own fault when you come off.

i suggest considering it a lesson learned, and make better obs next time.

I understand what you're all saying bout ti being my fault, I'll swear down it isn't though. i'm the kind of person that'll admit mistakes and I didn't do nothing wrong here and I feel like I've been robbed.

I knew that was coming up Ste, I've been riding since about Last June but only been through test since December. You're probs gonna say I'm inexperienced and it was all my fault. I know Im not that experienced but the conditions were poor so I made the judgment to ride slower and take slightly wider lines round corners and I still crashed.

You stand a very good chance of hitting the jackpot. Ambulance-chasers-4-U just love representing cloth-eyed dimwits against councils who see it as a challenge to:

a) See how much Council Tax they can piss up the wall in legal expenses for their chums.

b) Piss away an equally exorbitant amount of other people's hard-earned money in bent compensation payments.

Make no mistake, Slick - it was entirely your fault. Now quit blubbing and grow a fucking pair.

what you're saying is pretty much the same as someone posting here saying they binned their bike on a white line in the wet.

you went slow... it wasnt slow enough

you were riding on grit and gravel... why didnt you see it?

It sounds like the sort of debris you get on roads after heavy rain - inevitable really - you just have to be aware it could be there.
