Anyone have experience of being outsourced?

Hello everyone,

I got told a couple of weeks ago that my job at the company I've worked at for 3.5 years is outsourcing my job at the start of April. I have been presented with two options -

A) Mutually agree to end employment on the 31st March and get a 5k tax free lump sum.

B) Carry on with the new employer in the same job.

Now the job I do is not skilled but I have managed to get my wages up to a reasonable level through good performance, in fact, I got a 7% rise today. I do think I would have trouble finding another office admin job at the same salary, on looking around they all seem to be around 4k a year less. I also get private healthcare and dental, a pension and a share scheme.

My first thought was to take the money and find another job. However, on thinking about it I'm leaning towards staying - the job market is pretty rubbish at the moment, particularly when I don't have any specific qualifications, apart from A levels etc.

Now I believe that the 'TUPE' legislation may apply but this looks like it could be a bit of a minefield. Basically, I think I'm entitled to the benefits I had before the outsourcing? Does this mean my salary must not be cut and I can't lose my private healthcare?

What happens if three months down the line the new employer choose to get rid of me?

Have any of you been in a similar situation? I'd like to hear your experiences if you have.

I've not personally been there, but it happened to some friends of mine recently in my last place of work.

The job market is rubbish so I would say stick it out as long as you can, but DO look for other work constantly as something may crop up.
My 'outsourced' friends were soon got rid of, so I wouldn't get complacent if you stay on.

I think TUPE should apply in which case they can't get rid of you in 3 months for no reason.

Not sure about the healthcare.

I'd stick with the job you have. 5k isn't a lot and don't forget that if they did want rid of you in the future you'd get a redundancy payout.

Find out just what would happen payout wise if the new company went tits up.

From what you say your old job is going, there for you are being made redundent, payout time, that 5K is well above the min payout they need to pay.
And a new company is taking the roles over.
Now unless the new company that is taking you on is going to honor your previous employment time.... Take the money and apply for the job with them.
If you are as good as you say they will take you back on Karma

I think you would be better off talking to a union or someone that knows the employment regs on this.

I know nothing about this subject at all but one question that I do wonder is: Why is your present employer outsourcing your job? There must be a reason.

Hi Joe

My OH in his current role has been TUPEd 3 times in 10 years

He has kept all of his benefits etc from his previous position/contracts (this is policy apparently)
He has never thought twice about doing it as you are protected. You will get paperwork. Read it!!!

If they choose to get shut of you in 3 mths time for performance related issues etc then fine. They need a legitimate reason. You are THEIR employee, not a 'problem to get rid of'
If a company does a TUPE they accept the staff

If in any doubt speak to your H.R. That's what they are there for. Confidential

I was outsourced last February, or should I say my entire department was. Nothing changed, it was just a case of getting a new contract and a new boss. Same office, same job but different employer paying my wage. Fortunatelty nobody here is despensable at the moment.

As far as I know, if the workplace here decided to close the department then my current employer should be able to find me another job within the company but it would most likely be at a different site.

I'd go with the general advice to stick with the job, although £5k in tax free cash must be unbelievably tempting.

See if you can find out what the new company is like to work for, and promotion prospects etc with them. I'm assuming you've been with the company a few years and want to stay a while longer, or at least you don't hate everyone on your floor with the burning passion of a thousand suns, just begging for a power cut so you can off a few of them with a letter opener then frame Brian for it, that snivelling cunt who stole your woman, he'll pay.
