Does anyone else think the arrest is correct and all the crap about letting him go etc is just wrong Question

FFS he raped a minor... therefore he is a paedo. Doesn't matter if it was 30 years ago.

He didn't rape her, he had unlawful sex with her. It's legal to have sex with 13 year olds in some countries so does his paedo ways change from country to country or is it just because we're socially conditioned to believe that anyone that touches anything under 16 is a child molesting bastard, with the exception of Michael Jackson?

I'd say there's pressing case for calling it abuse here, ie he's abusing his position to sleep with a girl that otherwise perhaps with later years wouldn't have made the decision to sleep with him but that's not rape in the context that she didn't have consentual sex. Well from what I've read anyhoo....

It's a very complicated law case that TBH I'd not like to call either way, I'm glad there's peole in positions that know far more than me that'll make decisions like that on "our" behalf.

So he drugged her and gave her alcohol. At age 13. If that had been my daughter he'd be blind, handless and balless now. But then I wouldn't have been her scumbag parents that allowed her to go on a 'modelling' shoot in the first place.

Trouble is, the people who were supposed to make the decision 30 years ago cocked this up, (excuse the phraseology.) Polanski plea bargained (a contentious area of US law) and was 'promised' 16 months to three years incarceration.

The judge at the time reneged on that, the maximum for the crime could've been as much as 50 years. Apart from anything else, the judge going back on that deal undermines an incredibly important aspect of US justice, it saves them billions in court costs if the accused plea bargains...

That was why he ran. That said, I don't think he should get off with it although I'm not sure what would be suitable in terms of punishment given he's not been able to return to the US for the past 30 odd years.

The victim also wants it dismissed, I would venture the opinion that if it was to be dismissed, they'd argue it wouldn't encourage anyone else (or detract from any deterrent effect of the law) given the unique aspects of the case, (i.e. if you have unlawful sex with a minor, you'll get away with it if you leave the country for 30 years.)

I agree with arry's post, it doesn't make it right of course. But consensual sexual relations is very hard to legislate as people develop at differing speeds. What isn't up for debate is when it's a clear cut case of coercion, rape or sexual assault.

In Polanski's case, he'll either be let off with time served or he'll do six months in a soft penitentiary then be allowed to get on with what ever it is people like him do.

The entire field is FUBAR, and I suspect a lot of it is down to sad resentful old men in govt who want some but know they'll never get any.

Who decides when a girl is old enough to willingly get some? What's the difference between her getting it from somebody her own age or somebody much older? There's a whole culture of bullshit that's been created around nascent sexuality. Time was a young boy or girl would have been fvcking grateful for a good time from somebody who knew what she/he was doing. Now it's suddenly a dirty concept. And there are young girls cursing the day the state decided they couldn't have it so easily anymore. I remember that woman, from some dept of child-protection, coming out on TV and saying how "We should all remember that a lot of these chat-rooms are inhabited by sexually predatory young girls." That was a bit of an eye-opener. Laughing

Age of consent in Austria is 14, no age-gap caveat. Spain is 13, and again with no caveat.

Agreed.

The law still favours the female though which can be problematic. The ages of consent you talk about do have certain mitigating circumstances though, namely; if a child (say who's 13) has a sexual liaison with an adult who is much older (say 30.) It would still be investigated as abuse if it came out or if a complaint was made.

There'd be no talk of unlawful sex, it would be sexual assault in the same way it would be with non-consenting adults. I wrote a piece on age of consent some time ago, it varies wildly. 14 in the Netherlands, in Mexico the minimum age (for both orientations) is 13 with the caveat that they must be close to each others age which seems sensible to me.

Obviously nothing to do with Polanski, but a 16 year old boy could find himself on the sex offenders register for dallying with his 15 year old girlfreind which to me seems heavy handed.

Some interesting stuff in this thread. It is a very complex area and trying to cover it with "blanket" legislation won't work. Another thing I'd like to pitch in is that if it had been me who had sex with a 13 year old girl the media would have absolutely, and justifiably, hung me out to dry and my feet wouldn't have touched the ground on the way to prison. However when it is a media luvvy the same doesn't apply.

He already pleaded guilty. And he ran, which is another crime.

Why should there be any problem? Because the victim would rather forget about it? That's not the way it works.
