As far as I am aware you can only ride / drive without MOT or TAX to a pre booked MOT test providing you have insurance.

You can get insurance without MOT or TAX. Can get MOT without insurance or Tax but cant get tax without the others.

If stopped with no tax or mot then the police have the power to seize the vehicle and stop you driving it thus causing you to get insured and booked into the MOT station before paying them extortionate amounts to pick the car up.

In truth, if you get stopped with anything missing the police can stop you from continuing your journey in the vehicle.

If you crash then I belive it negates your insurance. Without MOT your insurance company can refuse to pay out on grounds that the car was unroadworthy.

Hi

Can't see why. Under the road traffic act once the insurance company have issued a certificate they are liable for 3rd party claims and cannot just get out of it. So you are insured against 3rd party liabilities so no offense committed.

They might try and claim back their expenses from their insured, but they can try that anyway.

Not to 3rd parties they can't, and 3rd party liability is the only cover you legally must have.

You can drive to the MOT test without tax or MOT provided its pre booked and you go by the direct route.

Make sure its booked with your full name and your car reg number and take the garage number with you on the journey.

Can see the insurer reducing cover to min legal cover, but can't see how legally you could be done for driving without insurance if the insurer has issued the policy.

Thanks, I'll bear that in mind. My two weeks grace for the tax runs out the same day as the MOT so, if/when it fails, I'll have to declare it sorn until the works done/cars scrapped and new one bought.

Car MOTs are a nightmare compered to bikes Rolling Eyes

Hi

You will likely get a months grace before they will offer to take a bribe instead of taking you to court for not declaring SORN. However there is no grace for using an untaxed car on the road (just the exemption for pre approved MOT stuff).

There is a 5 day exemption for not displaying a tax disk, but only if you have already bought one online before the previous one expired.

Driving without an MOT
If your vehicle is at least three years old, it needs to pass an MOT test before it can be considered roadworthy. Driving a vehicle that has not successfully passed an MOT test can land you a fine, but will not usually result in penalty points.

I was told when I rang up the Tax people that I had 14 days from the old tax running out to renew it or decalare it SORN before they fine me. The car can't be on public roads in this time unless going to a pre booked MOT.

The period of grace for road tax varies from nothing to a couple of weeks. Officially there is no period of grace, but computer glitches and postal strikes have resulted in leeway being given in the past.

The only offence that I can think off off the top of my head where you might suffer a consequential offence of no insurance despite producing a certificate is if you were found to be riding/driving not within the conditions imposed on your license (i.e if you didn't have a license for that vehicle). This is because insurance policies have the wording 'provided that the insured holds or has held and is not disqualified from holding a license'.

Someone like Mister James would be able to clarify.

Yes, but as Kickstart rightly says above, if you have a policy, in your name, for that vehicle, then you have third party insurance. End of story - the insurance company cannot get out of that no matter how they word their policies.

It makes sense when you think about it. Anyone who's ever had to deal with an insurance company knows the first thing they do is try to find a way to get out of paying. If they weren't forced to provide the legal minimum cover, the whole system would fall apart. You'd be hit by someone doing 35 in a 30, and be told by their insurers "Sorry, we only insure him while he's driving within the law - he was speeding so he's not covered"

Yes, they have the option of going back to the insured person and trying to recover whatever they had to pay out, but that's a seperate issue which doesn't affect in the slightest whether or not the person was insured as far as the law is concerned.

People DO get done on that basis. But I'm convinced they should be - merely that they bend over and take it, so it all goes easily for the police/CPS/courts.
