Long story short;

Overtaking a car, he turns into a driveway without indicating. (December 2010)

Outcome: very slightly bent forks, slightly bent handlebars. Estimated repair cost: £1600 pounds. (I can fix it myself for around 400 quid)
Bikes worth: £1600 pounds. (agreed valuation)
Pillion (wife) hurt her hand, I am ok.

Witness says "a bike was overtaking a car, car was not indicating, he turned right and clipped the bike. BIKER WAS AT FAULT" (I know it doesn't make sense but she is a 60 year old granny.)

Now my insurance company wants to admit liability and fork out 1800 pounds for personal injury to my pillion.

Here is the question:

How important is witness' personal thoughts? According to the highway code cager is at fault. But the witness says the opposite. My insurers says "highway code is not relevant". They don't want to pay court fees if it settles 50/50 and my solicitors believe it will. (or they just want to make more money by going to court)
Should I admit liability and get 1800 quid. Or, go to court?

Her personal opinion means nothing....

Go back to them and say read the statement again. I'm not at fault. She says you were overtaking a car that turned without indicating and cliped your rear, unless there are some road marking that make you being there iffy. Such as having hatchings or solid white lines.
I would try a diffrent solictor as your seems to want to end the case and get their payout, doing as little as possible.

So your Mrs is suing for personal injuries..... and your ins could end up paying out.... Classic... Laughing

Ins co's seem to be opting out of making a decision and putting the onus on you.

Fuck me, your wife gets £1800 through an accident that is technically your fault (if you decide to admit liability). Compensation culture at it's best.

It will settle 50/50 everybody loses, insurance are scum. It will take years to settle and at the end of the day you risk far to much going to court as your insurers will not back you.

The thing is I am not risking anything. If I lose at the court Mrs. gets 1800 quid. If it settles 50/50 I get 1000 quid. Mrs gets 1800 again Laughing
Either way I lose my NCB and get the cash to fix my bike and cover insurance premium increases.

I don't want to cause an argument or get bashed here, but, I believe you are liable. Despite the fact that yes he was a knob who didn't use his indicator. You need to read the road ahead and say. Ok driveways on the right and therefore a car could enter or exit one of these at any moment.

Technically your fault and hence why your insurance company will blame you. However, we all know that idiots and indicators cause the accidents.

I got done many moons ago for a similar accident, police charged me for careless and inconsiderate driving even tho a bike cop told me he would have done the same filtering at that spot, I think as far as insurance claim went tho it was 50:50, so even if you don't take the full blame according to the insurance be warned you could end up with 5 pts on ya licence!

He did read the road ahead, it was safe and legal to overtake so he did.......
unfortunately the driver didn't indicate and didn't look then turned into the rear wheel of the motorcycle and knocked them off...!!

for the driver to do that it means he didn't see 75% of the bike go past in front of him as he turned and clipped the last 25% of the bike...ffs the only way the motorcyclist could be "liable" was if he was illegally overtaking,

Yes "there were driveways on the right".....and other hazards too I would guess, and I assume the OP gave the car a wide birth and was observing his surroundings all through the manoeuvre......but he was almost past the car when it turned and hit his rear wheel so obviously the driver wasn't reading the road or observing the hazard that was a large motorcycle with lights on making a loud noise with indicator flashing as he was overtaking

unfortunately the law and insurers will probably go along with the overtaker gives way to anything that happens, just like if you run into the back of a car

I fail to see how the op is at fault if he overtook legally and was clipped by a car changing direction without looking. Rolling Eyes

Overtaking when there are driveways is the same as when there is a junction. If you are going to do it you need to be extremely careful and make sure noone is turning in or out of them. You can't see everything granted. But insurance will most likely still say you should have read the road and realised he was slowing down and or getting ready to turn.

OP what part of the highway code are you suggesting that you were in the right? As far as I was aware traffic in front of you has priority and right of way, and as such was well within his right and lawful to go in whichever direction he sees fit.

None of us were there so it's all speculation but I doubt for a second anyone just turns without slowing down or giving no show of intention whatsoever.

You made a bad call chalk it up to experience and get over it but you have to take responsibility for your own actions!

Exactly as Rogerborg has said. The accident happened and as the overtaker it is your responsibility to ensure that it is safe to do so. It is not safe if an accident occured. A driveway is a junction. Just because it doesn't have lines on it and a sign saying give way does not mean you shouldn't expect a hazard at each and every one of them.

BTW, I am not having a go at the OP. Accidents happen, and I am sure you feel rough about it as it is. I just reckon this is how your insurer will be looking at it as well. The guy coming from behind normally gets blamed.

People fail to indicate or make gestures towards turning off all the time, believe me I see it every day on the road.
The witness statement basically is in favour of what the injured party, the rider, has said and only supports his case.
I think what he needs is to go to a firm such as Rider Support Services who will aggressively pursue the claim for him, he should disregard the insurance's suggestion that he settles for admitting liability as it clearly wasn't his fault. This is particularly the case as it was the rear of the bike that the car clipped i.e the car was behind him at the time he was struck.
The driver failed to observe, failed to indicate and caused the accident as is clear from the witness statment.
The last thing he should do is settle with no contest.

Technically and in law a driveway is not a junction as it doesn't form a part of the public highway.
The failure of the driver to observe, indicate and position himself appropriately was the cause of the accident.

Replace that with "potential hazard" which is something that needs to be considered before overtaking.

Legally he was in the right, the driver is in the wrong. The witness statement only backs that up. He clearly has insurers who want to minimise their own costs by means of paying off the other driver, but his legal expenses policy should allow him to defend himself anyway and he needs to make it clear to them he will not admit liability.
The fact that it was the rear of the bike the driver hit only adds weight to the fact that the driver failed to observe before commencing his turn. If the rear of the vehicle is hit this is usually taken as an indisputable admission of fault on the following driver's part.

So all the time you see people capable of turning through 90 degrees into a drive way at 30mph with out slowing down and with no change of road position at all?
MSM is not the be all and end all of turning and just because someone doesn't indicate doesn't mean there are no other indications of their intent.
Most people will swing out the opposite side if they are not going to brake for the turn, most people will slow and show brake lights before turning but alot of people bikers and drivers see brake lights in front as an opportunity to overtake which can lead to this situation, and to deny that is frankly a bit naive.

Even the Blue Book (Police riders guide to better motorcycling) Pg 136 the very first listed hazard during overtaking is the vehicle. infront.

From my experience most insurance companies will not accept liability if they believe it was the others fault. So I would be surprised if they were happy to pay out if they thought other party was to blame.

None of it is 'illegal' but it they are all considered rules within the highway code which determine the outcome of most insurance claims following rta's. Any court would pay reference to the basic requirements placed in the highway code to observe, signal then manouvre before turning off. The driver clearly did none of these so was at fault.
The 'legal' judgments made by a court would stress this, the witness statement only backs him up.
His solicitor is apparently telling him that the highway code does not matter in this issue! I'd suggest he finds a bike accident specialist that knows what they're doing.

My opinion is that most insurance companies base their judgemets on 'how can I get out of this costing me the least'. They'll use the highway code rules to argue when they think they have a good chance of non-fault but if there's a fair chance of shared blame and the other side look like they'll put up a fight they'll opt for a 50/50 to save on expensive solicitors fees.
