This post is massively overdue. I was in an accident towards the end of February.
Basically, I was travelling along, around the 30mph mark. A car pulled out of a give way into my path. I tried to stop but there wasn't enough time and I went into the off side rear of his car. Me, the missus and bike went for a slide up the road. Resulting injuries, I broke 3 ribs and my right thumb. The missus had worse injuries and broke her elbow. The bike was trashed (bent forks, smashed plastic, broken controls, engine cover, etc)
We were collected by ambulance and enjoyed some gas and air. I'm out of cast now, the missus will be recovering for quite a while.
The insurance company valued the zzr (pre accident) at 1200 and let me keep it for £50! Nice. With help from a fellow bcf'er the bike is in bits awaiting a clean and ebay. (thanks Mr Fisty!)
Insurance is working on a payout for injuries, although I've been told this can take a while.
I've replaced my transport with a virago 535, although I've not riden it much yet and it hurts to use the front brake!
Anyway, I've done a paint diagram, enjoy.

I have now acquired a MC!
Erm, I got £5000 for a broken thumb and write off GS500, bike was valued at £795.
I didn't claim for any sore neck, legs or anything...would have got more but wasn't worth it.
Obviously you'll get a fair figure from it. I spent a fair whack of mine the day I got it...go careful  |

Based on what? It could be more depending on the circumstances of each individual claimant, no two claims are ever the same, and it all comes down to the severity of the injuries, period of incapacity, and who prepares the schedule of costs.
I have seen some injuries such as this obtain as much as £20K some as low as £3K
To make a sweeping statement such as you have made is dangerous and incorrect. Because you may have received a certain sum, does not mean that others will receive the same, it could be higher or lower depending on personal circumstances.
If the claim is being handled by legal insuarance appointed solicitors, then be prepared for it to be severely undervalued, as one member here can testify to.
His case was settled inside 3 months for a stupid low amount, despite him having a brain injury, all because the solicitors wanted shot of him so they would get paid.
I am sure the member will be along in due course to back this up, but suffice to say, £6K is just a figure plucked from the sky and has no foundation or substance ____________________ It is better to arrive 30 seconds late in this world, than 30 years early in the next |

sINCE YOU SEEM TO BE IN THE KNOW AND i THINK YOU HAVE SPOKEN ABOUT INSURANCEY STUFF BEFORE (opps caps) how much do you reckon I could be in for (if anything) for a smashed up foot, nothing broken but a trip to a&e and my foot looks like this.

Good luck, I was pulled out on by some druggie twat in October 2009 and I'm going to court this year (hopefully!) to determine liability. Not seen a penny yet.

Given that nothing is broken, it will have some value but it is not going to be worth a lot.
As I said, it all dependss on many factors.
The severity of the injury
How long you have been incapacitated for?
lack of amenity
Loss of earnings (if any)
The claim is then divided into two parts
General damages which is the value of the actual injuries you sustained, and which includes a payment for pain and suffering
Special damages which is covers everything else such as damaged clothing, travelling costs, prescriptions, loss of earnings and the like
The two are then added together to give you your total award.
Unless there are broken bones, it is very unusual for the claim to be valued above £1,000 unless it is something like severe muscle or tendon damage, or a very severe dislocation
For a solicitor to be able to claim back there fees and costs from the third party, the value of the claim has to be over £1,000, and in what is called fast track claims, it is done under the portal system which limits legal fees on low value cases to around £1400.
The values of injuries are determined by the Judicial Services Review board who revise the figures every year, and each injury is classified and valued in three categories, minor, moderate and catastrophic.
So whilst many people believe that they can make a lot of money from personal injury claims, it is relative.
A serious brain injury and paraplegia is only worth about £280,000 at the top end, whilst a broken tooth is worth about £600 at the bottom end
But in serious cases there is also what is called the Ogden table which allows serious cases to be valued in more detail.
But back to your case, yes it has a value, but don't expect to be buying a new mansion on the proceeds. ____________________ It is better to arrive 30 seconds late in this world, than 30 years early in the next |
