What a surprise, I sold my bike at the end of February, was collected at the beginning of March.... then the thing kept coming back to haunt me (being stolen, recovered, impounded, log book returned to me, all of which was logged with the police by the new owner).

They sent out a letter demanding money from me, which I ignored... I got the court summons through a few weeks later, so I sent them a slightly sarcastic letter, with the paypal transaction, receipt from the sale, photocopy of the returned log book with the new keepers details on it... all dated March. But they claimed I hadn't notified them by mid July.

Today I got the following letter:

In view of the further information received. it is the Agency's intention to withdraw the charge against you for hearting at ABERGAVENNY COURT on 03/12/2012. In relation to the alleged offence concerning motor vehicle L157***.

Consequently, it will not be necessary for you to atend the hearing on that date.

Should you need to contact us, please quote the registration mark

To be honest I'm just glad I'm not going to hear about it again.

Back in April when the bike was stolen I contacted the police about it and they said that because it wasn't me that reported it the DVLA would update their records (I think it was about then the logbook was returned and I thought there was some kind of con going on), then in June I got a letter saying that the bike had been recovered and I had to pay X amount because of this.... again more phone calls to the police and the recovery company.... who basically told me it had nothing to do with me and the DVLA probably had a backlog and would update their records in due course....

I have absolutely no intention of getting in contact with them again regarding this matter.... unless of course they send me another letter about it

i'd personally be inclined to send them a "demand for payment"

"under regulation you caused me much hastle, stress and grief, now you must pay you are hereby instructed to pay mr andyM the sum of £5000 to be paid in full by 15th December 2012 as compensation for the mental stress and fatigue along with UN-necessary harassment regarding case XXX-XXX, failure to adhere to this instruction will result in legal action being taken against the DVLA"

just to see what they say, never know, they might just offer up something in the way of compo, if they reply at all that is

A win for you, sort of. The next time the DVLA lose whatever paperwork I send them, leading to them sending me speculative invitations to pay a bribe. I want them to take me to court, I will really enjoy the opportunity to put my evidence before a judge and see the useless parasites trounced in court.

I did take pity on them, I had actually planned on calling the police officers that dealt with the theft, the recovery company and police when the bike was impounded, the middle man who bought the bike and the guy that he sold it to, every scrap of paper relating to the bike and the sale of it... take it all to court and have the DVLA pay for it all Twisted Evil

Not sure if it would have worked or not.... might have got it all to court and have it thrown out before I even got into the courtroom.

Win, eventually.

However, you've received a summons. Unless and until the court tells you that the case has been dropped, it's still game on.

I mean that in a good way. It would be an awesome laugh to turn up with all of your documentation, including your estimate of costs, and receive a default award. Wink
