Ok, so basically I recently quit my job, and enjoyed a month off before now starting a new job.

During this past month I've spent most of my time in my garage, tidying up, music at a respectable level/ off in the evening, lights on when it gets dark but not shining into any of the other flats and I keep nearly all my own noise to a minimum, the only exception being maybe 5-6 times in 4 weeks I've used my angle grinder for periods of about 5-10 mins, and arc welder in the evenings when it's getting dark, although garage door is shut (got an extraction fan, the flashes might be able to be seen under the door.

The problem I have is during this past month quite a lot of the local moped lads (at any time up to 10, generally only 2 or 3) have been turning up, asking if I can fix something for them.
And as everyone knows, mopeds are bloody horrible at the best of times for noise, especially the ones who's exhausts are blowing at the manifold...

I've got a meeting in the morning with my estate agent as apparently some of the other residents "want to take legal action against me". Confused

I'm not trading out of the garage, although people do give me money for any parts that are being bought (some of them don't have bank accounts so I take cash and buy for them), but I think that the estate agent thinks I am.

Any suggestions on what I can say to the estate agents?
I've only just got in from work and have read their letter!
I've already told the 'ped riders that if they need any help I'll go to them and not to come to mine.

What exactly do you mean by "estate agents", and what powers do they have (actually have, not think that they have) to arbitrarily terminate your residency?

If, as I suspect, it's f​uck all, then I wouldn't bother giving them the time of day.

If the other residents want to "take legal action", wish them the very best of luck with their 5 year mission to persuade a magistrate to ask you to keep it down a bit.

All that said, pedbois will turn on you sooner or later, especially in packs. I have no idea why you're getting involved with that.

The photo will be removed in 48 hours anyway, just wanted to be able to show a few of you the layout.

As far as "estate agent", they are the ones who hold our (there's 3 of us in this flat) contract with the landlord.
Not sure on what they really want today but I think they just want to give me a chewing really.

Sometimes it has been late, i.e. past 11pm, but that's only me and possibly one friend (no mopeds) and we keep the garage door shut and music down.

I do realize that the "pedbois" will eventually start coming round again, but I plan on moving out of here soon.

They cant do anything really tbh unless there's proof, even with that they need to give fair warning first, that's if there is even any clause in your tenancy agreement that states anything along these lines otherwise the estate agent has no power at all. That's just in terms of having you kicked out

As far as "legal action " goes, you can just laugh in their face tbh. They would have to ring the police whilst your making noise Abd the police will just come and tell you to be quiet, unless that happens on like 100 consecutive nights nothing more will happen

Basically, jack shit is going to happen

I suspect that is the mainstay of the complaint. One bloke pootling along minding his own business in his garage is no big deal.
10 scrotes on peds hanging around is likely to cause annoyance.
As Rogerborg notes, why are you getting involved in that??

Then you have absolutely no concerns. It would take months to get shot of you even if they started the process tomorrow.

However, it would be considerate to find out what your neighbours' specific issues are, then see if you want to address them.

If it's just NIMBY "Well I never" spluttering - which I'd rather suspect from the risible threats to go straight to "legal action" Rolling Eyes - you can ignore with a clear conscience.

However there could be a shift worker or some spazvalid who's being driven proper mad, I tell you, that you might want to consider if you're asked politely.

I never understand why people do this.

Scenario - If a neighbor knocked on my door with a polite request, I don't know, maybe they work late on Fridays and would rather I didn't mow my lawn before 10am on a Saturday. I'd prob agree to that, sure I'm allowed to mow my lawn earlier, but they asked nicely and its no real hardship to me.

But if they started by trying to force me with landlords or councils or such rather than talking to me? You can bet your arse I'd swap the flymo for the loudest petrol mower I could find and start mowing as early as I could without breaking any noise laws.

Hell, they don't even have to talk to me - a polite note through my door would do. The key here is to let me know I'm bothering you in some way before bringing 'the authorities' down on me.

I'm not intentionally, but they know that I am good at fixing their mopeds, and if they give me a fiver or tenner/ crate of beer/ pack of cigs, then I'll do it, much cheaper then them going to going to a local business (who nobody really likes due to him overcharging and taking weeks to complete things) , plus I do it to a better standard and it's done there and then.

I've just got back from the estate agent, apparently the Managing Agents of the property are getting complaints for other residents, that's then being passed onto the landlord.
They have told me that I have got 4 options right now;
1) I move out,
2) They take away the garage keys,
3) We all get evicted,
4) I stop all my friends from coming round permanently.

I've chosen number 4, with number 1 coming as soon as I can arrange things.

They also told me that I'm too push my motorbike to the end of the road before starting it...
I told them they're having a laugh, that I'm on a nearly silent 4 stroke and it makes less noise than any of the cars around here and if they want me to push it to the end, they can enforce making all the car owners push their cars to the end of the road too!

Oh, and I'm not allowed to be out in the garage doing anything.
Just a little annoying really.

Things seem to be sorted now and hopefully people on mopeds stay away. Bounce!

I agree, if any of my cowardly neighbors had actually said that the noise of the peds and bikes turning up was annoying them, I would have stopped them from making noise.

As it is, noone told me anything until I got this letter! Mad

Yup, I've never had one person come to me and say "can you keep it down" or "you're making too much noise" or anything else along those lines.

And as for the business side of things, not intentionally, sure I get something in return for helping people out (so would 99% of you) but I don't charge for anything I do, people just give me things. Smile

The main problem really is that if I'm in the garage, fixing/ making something/ cleaning up or anything else and someone turns up asking if I'm coming out, it's easy to misconstrued it as me working for someone.

Eitherway I've stopped now, going to have to lead the boring life and stay indoors now.

I was thinking of a more civil approach and write/ print them each a letter saying I'm sorry for any noise I've made over the past month...

I work supporting homeless people and those threatened with losing their home. You are being bullied by the agent and they cannot just wave ultimatums under your nose on some spurious claim they have received complaints and you have broken your tenancy agreement (IE breached contract).

Contact the housing charity Shelter, they have a very good legal advice service and can equip you with all the knowledge regarding your rights as a tenant (which are many) its actually very difficult to evict someone and requires court action. I'm not sure how its handled in Enlgland but up here in Scotland no sherriff would grant an eviction in your circumstances.

I would also suggest you keep a record of anything noisy or potentially ause for complaint that others in your block or area are doing. Please keep us updated I would be interested to know how it pans out.

All of which is complete bollocks. As a tenant paying rent, you're entirely within your rights to have use of all the facilities you're paying for, as per your tenancy agreement. You're also entitled to quiet enjoyment of your property, which includes having guests to visit regardless of the time - it's none of their business.

What I would be doing now is first of all asking the management company to confirm in writing what it is that they want you to do. Make sure that it accurately reflects what was discussed in the meeting, and then tell them that you're seeking legal advice on that basis. They're going well beyond their authority to a spectacular degree, and need standing up to.

Remember, you're the customer, and unless houses are in massive demand, the landlord isn't going to want rid of a paying tenant just because he uses the garage. Estate agents are scum

It sounds like the landlord has other higher paying tenants lined up or wants to play the market rather than re negotiate rents.

I would think the neighbors were scared to come to you incase you were one of the ped boi scrotes and would turn nasty on them or you would set your ped boi scrotes on them.

As has been said, keep using your garage, aslong as you keep the noise at an acceptable level at required times and stop the ped bois coming round at all hours you shouldnt have a problem.
