There is a treatment that pretty much eliminates the risk of a hiv infection taking hold if you take it soon enough, kinda hope it doesn't work in this case.

There's a post on a forum I'm on with some legal boffins and the short of it is... because she was asleep, she couldn't have told him anyway so therefore can't be sued for infecting him (if she did).
