I'll just chip in my two penn'rth, as an MOT tester.
A fan guard isn't specifically mentioned in the test manual, but it could be construed as coming under Section 6.1 Body Structure: Condition.
A particularly picky tester might wonder if it would be possible to catch a loose item of clothing in the spinning fan, but because we are meant to give the benefit of the doubt, at worst it would be an advise and pass.
If you take it in and it fails on that particuler item, I would use the prescribed complaints procedure and appeal. ____________________ Things get better with age; I'm close to being magnificent........

To be fair, the design of most scooters is such that the fan usually has some other bit of bodywork between it and the user, so the risk of accidentally coming into contact with it would be quite low and, if you're stupid enough to deliberately poke around a high speed fan, then, frankly, you deserve all you get.
The only other downright dangerous things that spring to mind, concern tyres, where moped tyres only have to have a visible tread pattern and on all bikes you can have deterioration cracks the size of the Grand Canyon, but if the carcass isn't exposed, that's fine.
I'm also quite surprised at how poor brakes can be and still pass, but that's another story.
The manual advisory system only really exists as an arse covering exercise, so that testers have somewhere to put things that aren't covered by the test (which isn't much) but they want everybody, ie the DVSA, to know they've noticed it, if something goes the way of the pear at a later point; I think I've used it twice in the last year.
For all the important stuff, there's a complete set of tick boxes that allow you to pass, fail and advise. ____________________ Things get better with age; I'm close to being magnificent........

Good question and I refer my learned colleague to Con & Use Regs 1986, section 53:
"Mascots
53.—(1) Subject to paragraph (2), no mascot, emblem or other ornamental object shall be carried by a motor vehicle first used on or after 1st October 1937 in any position where it is likely to strike any person with whom the vehicle may collide unless the mascot is not liable to cause injury to such person by reason of any projection thereon."
I'm not certain how Rolls Royce or Jaguar got around this for many years after 1937 (before they made them collapsible, I'm sure a Spirit of Ecstasy could rip you a whole variety of new ones) but it would appear they are illegal, unless you mount them far enough back that they aren't dangerous, when they tend to look faintly ridiculous.
I should point out that I'm not a car tester, so I can't go completely definitive, plus it's worth noting that just because a thing is illegal, doesn't mean it's an automatic MOT fail, but I wouldn't go drilling holes in your bonnet just yet.

As I suspected, it's illegal, but not an MOT fail.
I have no idea what the offence code or likely fine would be, should a particularly clued up plod decide to write you up for it, nor do I know how many people have actually been prosecuted for a section 53 offence.
