So I live in a ground floor flat, and the people above us were having there windows cleaned.
The bastard decided to help himslef into our back garden (side gate is broke and haven't got round to fixing it) and scared the crap out of my daughter.
Unfortunately I'm at work so couldn't do anything there and then, and my other half was half asleep because she works nights shifts.
I'm trying to find out who it was so i can phone him and tell him next time he enters without permission I'll get the police involved and press charges.
I don't mind if he needs to go round back to do his job and I get on well with the family above, bit it's more the principle of him bringing it upon himself to get through (he must have squeezed because there is an extension making the gap narrow with a bush at the end, and the gate doesn't open fully).

Neighbour should have warned you it was gong to happen imo. He was just doing the job he was hired to do.
How else was he supposed to get to them without abseiling/hanging platform? ____________________ Currently enjoying products from Ford, Mazda and Yamaha

I'd check your deeds before you kick up shit, the owners of the flat above probably have what's called an "easment" which gives them access to your garden to carry out routine maintainance to their property.
As Roger says, Trespass is not a criminal offence in England (and doesn't exist at all in Scotland), you can't be prosecuted or arrested for it. You could sue a trespasser for damages but you'd have to show actual losses were sustained as a result of their actions.
Also, to be guilty of trespass, you have to have been asked to leave and refused to do so. In such a case, a landowner is then allowed to use reasonable force to remove the trespasser from their property.
Personally, I think you're being unreasonable. How the hell else is your neighbour supposed to clean his windows? If you speak nicely to the guy, he might do yours too for much cheapness since he's already there. ____________________ “Rule one: Always stick around for one more drink. That's when things happen. In what way? Admittedly I was angry, probably thinking a bit irrationally and won't actually do anything about it.

Guy with ladder comes to garden with tools, young girl alone get scared.
Seems reasonable.
I wouldn't kick up a fuss though, it's just one of those things that happens when living with other humans within 100m.
