As bcf has a lot of crash experience...

Came off last December, my claim against Mr audi is still dragging on because lawyers and lies - any clue how long a police report should take to arrive?

Second he hasn't put in a claim off my insurance, my insurance have given me an extra years no claims, safe to use this and declare non fault accident when renewing insurance on the possibly usable pile of scrap?

Until a claim has been made against your policy, there is no claim. If your insurer is aware of this incident but has increased your NCD at renewal time then yay!

Police report - no idea. I was waiting months before I got my brother involved. He works for Ministry of Justice and pulled a few strings and magically it landed a week later.

Police reports have to be paid for. I got it through my solicitors, which was actually a bad thing but I won't go into that (popo like to lie Rolling Eyes).

Not sure about the insurance situation, I thought an unsettled claim's considered at fault, and you're meant to then chase your insurer for a refund when it's settled.

If his Ins Co have sent a renewal notice with increased NCD, there is no claim.

Well this isn't much clearer! And call centre monkeys are no use either. Think I'm just inclined to go with the won the lottery approach.

Paddy - I'm claiming off his insurance, he's not claimed off mine at all, presumably because he knows he's at fault.

Police report was paid for by solitors months ago, guess I'll keep waiting as I don't have useful friends.

Then your policy and ncd remains unaffected though you should declare the incident for any future policies as non fault.

Just keep chasing and chasing the 3rd party in relation to settling your claim is all you can do.

Declaring accidents and claims is often separate though. Hence "no claims bonus" is unaffected when 3rd party is to blame or if you don't choose to claim off the insurance despite the accident.

Ask your cat, he deals with all your insurance doesn't he?

The general terms of insurance are;

"Give us details of any incidents, accidents or claims involving a vehicle that you've had in the last five years. Please include all incidents, including where you weren't deemed to be at fault, where you were driving a different vehicle, and incidents that haven't yet been settled."

Your name will be in the insurance database along with details of an accident, regardless of fault. Thumbs Up

If the letter of claim has been sent to the other side/driver and if he chooses not to pass on the letter of claim to his insurers, then the driver becomes personally liable and responsible

In other words, you sue the driver, and as he is choosing not to inform hos insurers, f you win, legal costs and all compensation comes out of his pocket.

The time to get the Police report depends on the force area. As a rule of thumb, anytrhing between 3 months and 9 months after the fikle was closed.

Although it is pretty much a case of photopcopying the fime, it is a certified extract and so certain parts are excluded or blanked out. This is done by one or two people and they will have hundereds to do.

The bigger the force area, the longer you will have to wait and this s providing the £60 disbursment cost to purchase the copy has been made in the first place.

He did tell his insurers, hence my claim against him. But he/his insurers haven't asked mine for any money so no claim on my insurance.

Wow 9 months?! It's Birmingham so pretty big, I won't hold my breath...
