I suffering some confusion about an ongoing insurance claim against a 3rd party.

In short: I was rear ended while stationary at a roundabout in Feb. 3rd party admitted liability at scene and since then has refused to reply to the insurance company as they chase their costs.

It's now been handed over to a lawyer. All fine so far, except that I recently received a letter from said lawyer about a completed schedule of uninsured losses? I didn't think I had any losses? I'd have thought that was between the insurance company and the 3rd party? Why am I involved at all?

Am I missing something obvious here?

Would be things like leathers, mobile phone, the laptop that was in your backpack. Anything you damagee that would be on top of the actual vehicle damage claim.

Then, on top of that, you can add any personal injury claim.

Uninsured losses are for all your out of pocket expenses

Damaged clothing
Damaged property such as watch, phone etc
Travelling costs maybe to the Hospital (you can claim 45p per mile)
Car park costs
Loss of earning
Loss of overtime
Maybe you have lost a holiday or trip away
Any insurance excess

These are called special damages

Any injury claim is classified under general damages.

Thanks guys, appreciate it.

Nothing except the bike was damaged and the 2 weeks or so of commuting costs are irrelevant(and receiptless).

Can you really claim back the excess on your claim?

Next time you go for an insurance quote it'll ask you if you've had any claims. One of the answers will be "not at fault claim, excess recovered" or similar so it's vital that you get it back.

Claiming your excess/recovering it from the third party is normally accepted as the proof you were not at fault.

But importantly, it does not mean you never made a claim.

It's what the insurers or brokers try to load your premium now.

It was seldom the case before.

Hastings tried that on with me.

My car was hit. I was in the house. The third party ins paid all costs. I never even saw a repair quote or an invoice for repairs.
Tried to insure a bike and Hastings wanted to load my policy. Even though I had not claimed from my insurers.
I did notify them but I never asked them to fix eff all.

An afternoon of phone calls to sort that Shite out. Twisted Evil

If you've had a "not at fault claim, excess recovered" then you've made a claim on your own fully comp policy which was then reclaimed from the at fault drivers insurance company.

When they ask if you've had any claims, that means claims against a policy of yours.

Well there are those who will suggest your policy should be loaded because you have made a claim. Fault or not.

They argue that there is risk. Therefore they want you to fork out for their perceived risk.

Money Saving Expert had a bit on this a couple of years ago.

The industry can see stuff we cannot see. So as soon as you put head above the insurance quote engine radar they can find you on the ins database. Smile

It 'should' be a No Claim if you recover uninsured loss but the market is changing and we are at their mercy. Sad
