It's a public toll road so it's a bit of both really.

In the event of an accident the police will get involved from what i've heard.

I always though the onus was on the person overtaking? In fact, I seem to recall reading advice about taping mirrors up, or even removing them as they are not needed on a track. This was for bike track days rather than cars I might add.

Pretty sure the Seat tries to overtake someone and then notices the Porsche overtaking him at the same time. You can see the 3 cars involved below.

Seat guy then abandons his overtake until the Porsche is passed him, then goes for it again and obviously doesn't notice the biker coming up on his left side.

I'm still sure the main person at fault is the biker.

That explains why he moved over Thumbs Up There's a flash of indicator as well.

Hmmmmm I'm in two minds about fault here.

With the flash of the indicator, the third (black) car that can be seen from halfway round the carousel (implying a reason to swerve left to overtake), and the fairly clear difference in speed between all the vehicles (Porsche, Seat and black car) I want to say poor obs from biker.
But at the same time I can also imagine the situation and seeing the Porsche go through and expecting the Seat to stay on line, behind the black car for the next left, allowing a bike to slip up the inside, putting the onus on the Seat driver to check mirrors (tough ask, in that situation I know!).

Either eventuality; fucking good save to hit a car, then the barrier and keep it upright.

Even as a mountain biker, I think i'd have dropped that on the grass.

Car is at fault, it's tourist day so normal road rules apply, he overtook without yielding to the faster traffic in the overtaking lane, no different to getting sideswiped by a car pulling into your lane without checking it's safe on the motorway while you pass at faster speed.
