Emanuel, who works as a consultant to banks in the fields of regulation and legal compliance....
Emanuel was found to be wearing a 'POLITE Think Bike' vest sewn over a high-vis police jacket, which bore three reflective strips on the sleeves- a feature only seen on officers' uniforms.
Hmmm.
Ex-plodbike, fitted with a non functional blue light (even the appearance of being a special warning lamp is a C&U offence, but apparently not prosecuted).
See if you can spot the problem with this conviction:
Offence: Any person who with intent to deceive impersonates a member of a police force or special constable, or makes any statement or does any act calculated falsely to suggest that he is such a member or constable, shall be guilty of an offence.
Any person who, not being a constable, wears any article of police uniform in circumstances where it gives him an appearance so nearly resembling that of a member of a police force as to be calculated to deceive shall be guilty of an offence.
Any person who, not being a member of a police force or special constable, has in his possession any article of police uniform shall, unless he proves that he obtained possession of that article lawfully and has possession of it for a lawful purpose, be guilty of an offence.

Legally, the magistrates gave him a whopper of a ground to appeal - lack of intent.

Well, it turns out that he wasn't a terrorist, but...
I strongly suspect this was a grumpyface stop that needed justified after the fact with a prosecution.

Impersonation, and wearing a police uniform, are listed as separate offences. Either suffices.

With no due respect to the muppet Magistrate who said otherwise, the man on the Sandford[*] omnibus would call that a deliberate and considered course of action that was intended to impersonate a police constable for the purposes of deceiving people into believing that he was one.
Not for malicious purposes, not for long, to break any other laws (more than any other biker or driver), but none of those are required. He intended to impersonate for the lulz, of that I have absolutely no doubt.

No way recman ...that is too harsh.
The PCSOs near me are next to useless. Patrolling parks whilst the estates suffer proper crimes. Then the PCSO post selfies of their smiling visage with empty playgrounds in the background.

I have seen loads of folk impersonating police officers.

I have seen an off-duty bike copper wearing a Polite hi-viz, which was fairly bizarre.
But the best "impersonating a police officer" prosecution has to be the Space Hijackers at G2O.
The did get off (one quote at the time from one of the girls was that if anything she should be prosecuted for impersonating a stripper), and eventually compensation and damages including for damage to their armoured vehicle, which apparently the police managed to crash into a couple of their recovery vehicles, writing them off, whilst trying to get it into the pound |
