gilera dna 50, when I first start and ride it it pulls way better, is smoother through what I can only describe as the automatic gear shifting (its a twist and go), and revs up way higher into the 9,000 rpm area when going. however when its warm it gets more sluggish and has issues sometimes dropping down into a lower gear

any ideas thanks

I'd probably bite the bullet and pop it on a dyno for a run. If it's all standard then you can at least check the service items, as your description isn't that clear about what's going on.

While twist and go scooters are very simple in theory, you'll find that if the jetting is way off or its running massively rich or lean, then it'll affect the transmission operation and vice versa. Its all about getting the motor revving to its power band and keeping it there until you run out of gearing. If it's running like crap at low rpm it won't have the power to accelerate to the flat part of the graph easily.

Running better when cold suggests that while the auto choke is on its better. Therefore I'd be checking that the choke is working correctly and turning off as it warms up, and that also something else like a blocked jet isn't causing it to run lean?

Probably worth taking the carb off for a full strip and clean out of all the passages and jets before you do anything else.

clogged air filter?

I'd check the choke/enricher too if its electrical
last scoot I worked on (a 125 4 stroke chineescoot) had a similar problem.
It would start OK then get boggy.
Its enricher had a heating element which should have gradually leaned out the mixture as it heated up and expanded
It didn't, the new one did
