Same.

I've converted quite a few. 👍

The approach to the junction. Girl turning left from the minor road on the left.

Clear warnings of an upcoming junction, what's looks to be some form of public or some shit on the right, again... We are different but I'd have slowed down there regardless, bike or car, like to 40... But that's because I've had kids run out on a 60 limit road from a harvester. I'd rather be more cautious. Car could have not pulled out, but could have also paid more attention to the surrounding areas.

Not an argument, just from what I would see...it'd be the one not adjusting their speed for upcoming hazards.

Same for me Paddy. But our common sense of what to do in case of idiot doesn't apply legally. Which is what I'm asking about 😁👍👍👍👍

His sounds the same as the one I'm describing. Car pulls out with no way of stopping - even with brakes slammed on.

👍

SMIDSY Thumbs Up

She should have argued that the other driver did not look. Even has history of doing it.
Should be a no brainer to apply blame to other party.

Indeed.

I'd like to know how you know she's been done before. Idea

She apparently rang her dad from the roadside. Who then arrived shortly after.

He told the full story about the last time this happened (and ripped her a new one at the same time)

Incidentally she is still not accepting guilt.

Without something exceptional, the insurance will side with the bird rear ended.

Given she pulled out of a side road. It is one of the few times hitting the rear of someone is not a clear cut "At fault"

Indeed. A lad I know of from the car scene was clearly speeding, at like double the limit or so Laughing car pulled out from side road, big boom occurs, rear ended guy held entirely at fault.

You can maybe get an idea of reaction time from this incident -

I like the insincere, "Oh no," when what he really wants to say is, "Yesss, I got it on video!"

So your lack of awareness joined with someone else's lack of awareness was all his fault.. k Laughing

Maybe we are different, but I would rather slam my brakes on when I see someone pull out than think 'theyll speed up'

Read the thread I linked, all the info is in there. You even commented in it.

If you don't mind me asking... With no camera evidence and your word against his... What swung it in your favour? And do you know why the Cps chose to pursue him for driving without due care in the first place?

His argument was that he had traveled about 30 meters past the junction before I hit him, the photo I took at the scene showed my bike at the junction, which showed him to talking bollocks from the off.

He was also offered a driver improvement day, which he turned down and fancied his day in court. His insurance conceded, which didn't really help his case in court either.
