Insurance brokers are cunts and would use absolutely any possible excuse to get out of paying our properly. Of course they'd use it to get out of paying should an incident occur Sad

They can't refuse to pay out to 3rd parties.

But they can come after you to recover what they paid. The guy 2 doors up from me let his labourer drive his truck and the lad flipped it wrecking a load of armco. He lost the truck and got forwarded a 30 grand bill for the armco repair.

I've wondered what would happen if you get into an accident at your workplace but weren't working on that day (eg you work in retail rather than some office block). I guess you could get a statement from your manager confirming that you weren't working on that day.

Pretty much that.

Some other staff will know when they were next expecting to see you at work.

It would be as easy to show that you really were going to the supermarket next to your workplace as it would be to show that you were commuting to your workplace.

Is it the policy holder they go after or whoever was behind the wheel? Confused

You can get in shit with the police for allowing someone who's not insured drive your vehicle, it's the person behind the wheel who's liable for whatever damage they do, isn't it?

In this case it was the company. The company insurance had a minimum age but the lad was below it. Didn't hear about any police action.

I imagine either would suffice; so they'll pick whoever's likely to have sufficient assets to pay them

The state can afford it or it can start cutting down those costs.

Or perhaps people should start riding around on these carts to make a point. Laughing

This has started quite a debate!

Seems the answer is just don’t do it.

I haven’t got commuting on the insurance as I didn’t think I’d ever need to ride my Vincent or 916 into London.

I’m just trying to think of the best thing to do for a back up bike should I need it.

If I still had my CBR I’d have that as a spare even if it meant paying the £12.50 a day ULEZ charge as still cheaper than the train.

What happens if someone kills a pedestrian on a mobility scooter?

Presumably they're not insured, and there's more and more of them these days, plus they seemed to be getting faster. I've no objection to them provided they're limited to walking pace, but I think the OAP's are getting the manuals out and 'de-rezzing' them!

Only a matter of time...

Exactly the same as if someone kills a pedestrian on a push bike or e-bike or whilst jogging.............. i guess it will become a Police matter, like the chap in Londonistan done for Furious Cycling when he hit and killed a women at a crossing (though that was somewhat different circumstances, as he had no brakes fitted to the bike)

Not being insured doesn't remove their liability.

Any action taken by the police is separate to civil action taken against the OAP by the deceased's next of kin.

People harp on about cyclists not being insured but if they've got house insurance then they'll almost certainly be covered under that for public liability which includes cycling.

Plus I think as times are going on, we are seeing more mobility scooters on the pavements.
They're going faster, hence more momentum (likeliness to cause injury).
We've got one old bat in Rugby (clearly completely senile) going at full throttle yelling at everyone to "Fuck off" or "Get out the Fucking way"

Speed limit of 4mph if driving an OAP buggy on the pavement.

https://www.legislation.gov.uk/uksi/1988/2268/regulation/4/made

Get out of the fucking way is good advice. Laughing

4mph? That's a very brisk walking pace.

Sadly no, I'll try and sneak some footage next time I see her out.
When she tells me to fcuk off for just existing on the pavement trying to take evasive action, god knows what she'll do if I point a smart phone at her. Sad

It's cheaper than an injury and you don't have to run over their no win no fee lawyer as well.

Many mobility scooter users do have third party insurance. My mum did when she had one.

Anyway, back to the plot: Get insured properly - it's really not worth the potential ball ache if it all goes Pete Tong.

I pretty much have to go past work if I want to go anywhere

mind you I also have business use on insurance as cheaper anyway
saved me over a tonne to add it and use car for other stuff for work

as for mobility scooters the 12mph ones are actually allowed on roads
and should have a limiting speed switch on them for use on paths

most people who have these have some sort of insurance as the people who sell them advise it for the very reason of what can happen (killing pedestrians )
problem happens when old person A dies and the kids sell the scooter to old person B who knows nothing about the insurance side of things

I worked in the industry for four years and spent mu childhood round them and the little three wheeler cars as dad always worked for a company that did them so school holidays were spent with him as mum worked in a shop and that was a more interesting choice
