Last Friday (6th) I came home from the gym at 8pm opened a new batch of protein shake (same provider and type as I have had many times before) which I had ordered a few days before. Made the same mix as usual , with water.

8:30pm after I had drank roughly half I began violently throwing up and similar out the other end... stomach cramps, aching joints, temperature the lot. This lasted all night and all Saturday, with me finally being able to sleep sometime Sunday.

I was drained most of the working week, used up most of my flexi to take short days. The next weekend I felt loads better. Put it down to a random bug and didn’t think much of it. Shit happens.

Come the following Monday (16th) I decided to get back on the shake as I was going gym after work. I made one as I left for work around 8. I started drinking it at 9 at work and again, half an hour later violently sick and out the other end at work. Boss had to give me a lift home.

I didn’t have the energy reserves as well the second time round so I was almost passing out. An ambulance was called and he had to sit with me for 3-4 hours through the worst of it.

Again I was out of action all Monday and Tuesday and off work weds and today.

So that brings me to my question - what do I do now?
Do I have a case for compensation?
How do I prove it was the shake? Do I send it off to some lab?

I very Rarely get ill so this sort of thing never happens to me.

Maybe you're allergic to something in the shake?

As above, food poisoning usually takes about 48h to kick in.

Go and see your quack, taking with you the product in its container with any packaging and supplied information. Edit: He will probably be able to advise of contents you may be sensitive to, or suggest an alternative product; some GPs specialise in "sports advice/treatment".

Yes, but the body will reject food pretty fast and put you into evacuate mode. It's a defence mechanism and there's a good chance you'll feel better quickly. Food Poisoning is a different thing that lasts days/weeks.

Crab meat has the same effect on me.

Give the container you drink out of a sterilise. Could be it's never had a good clean and is the cause. Especially in the tubes.

what company is the whey protein from?

you sure it isn't an issue with your shaker, those things start going rancid if you don't wash them properly within a few hours or at least rinse it out after and wash next day

I'd throw the mix container first.

Speak to both your doctor and the manufacturer. If the manufacturer want it returned then be sure to keep some contents for other testing if doctors want to do so. Take dozens of photos of the product container both outside and inside. When sending to the manufacturer be sure to send via recorded delivery so that they can't argue they didn't receive it. Demand reimbursement before sending - get agreement in writing.

You need to start that paper trail of evidence. Purchase receipts, proof of loss of earnings, travel losses due to hospitals etc etc. All communication should be in writing and recorded delivery with proof of a person signing for such things. Do not be fobbed off with reimbursement of cost of purchase of product!

My own doctors have sometimes sent samples I've 'produced' to local hospital teams who check for infectious diseases. BCF has medical folk already and they will advise better than I can.

Remember: You can only normally claim compensation for losses. Extra suffering is a different story.

Finally, do these protein shakes come under the same regulations as food stuffs? Are they made to the same standards? Obviously if it made you poorly then there's a case but if they're not considered 'foods' then you have a more difficult case to fight.

Yeah mine stinks if you leave it for longer than a few minutes without washing or rinsing it.

i've lobbed the container in the bin. not taking any risks, i thoroughly cleaned it last time so im faily sure it wasnt the shaker but again not worth the risk.

i contacted their quality dept and they just fobbed me off, but that was to be expected. they said there was no other reported cases so fair enough.

i dont have the energy to chase this up any further - my mate is going to test out the protein himself (aganst my advice). so lets see how this guinea pig feels afterwards.

I used myprotein when they first came about over 10 years ago but their quality got very poor around 4 years ago (I compete in bodybuilding so notice a difference between products as I'm a sad cvnt) - Bulkpowders are much better and have used them ever since.

Regarding the shaker, even if it doesn't smell or you can't see crap inside it can still have nasty bacteria lurking, generally after I've made a shake I will rinse it out a few times within an hour and wash up if I can be arsed or if not atleast wash it thoroughly within 12 hours (they key is rinsing out first - might aswell just wash it once you done that)
