Not sure if Jail was deserved really,when i watch the police tv snows occasionally, neary none of the stars of the show get jail time ,stealing /crashing a car and unprovoked assults,burglary etc seem to get suspended sentences ,unless they are seriois repeat offenders.

Indeed. It's a discussion we've had to have in our bike club since the advent of people filming and uploading ride-outs.

The uploaded footage need to contain nothing identifying other riders breaking road traffic laws. If ANY of the uploaded footage shows such behaviour (even if the person is not identifiable), the entirity of the original footage also needs to be erased or irreversably edited because the uploaded content can be used to obtain a search warrant to seize the originals.

This is not tinfoil hat stuff!

There is the excellent real-life cautionary tale of the member on here who after uploading footage of him messing around on the cat and fiddle, had his door kicked in first thing in the morning and all his computer gear seized under a search warrant. The police then had free rein to carry out a fishing expedition of every bit of footage present on those computers, cameras and SD cards!

He was (much) later let off with a warning. The police having informed him that they had been reading his posts about the incident (on here, yes guys, the police do read this forum) and had been impressed by his contrite attitude.

Then there is the whole issue of people skiving off work to go on runs...

Given that no actual harm was caused, the sentencing seems a bit much, in comparison with drunken drivers killing people, who never seem to have to do time.

People often forget that though a camera of some sort may be a helpful tool in the case of a none fault accident, they can be used against you and at any time they can be requested for viewing by the police much like a random stop and search.

Please quote the legislation to support your legislation. PACE only comes into play once arrested or a court order has been obtained.

At any time police may REQUEST to view your dashcam footage. This is a tactic often used in their position of power where people believe they cannot refuse to provide this. You are completely with-in your rights to refuse anything of the sort other than Documents such as ID or insurance.

However in any case where they believe it may have probative value they will request and/or present you with a warrant to view your footage. In cases where it is clear an offence has been committed and your footage is the evidence they will not to get it. In cases where they believe the evidence may be destroyed before they obtain a warrant they do have some rights to remove it.

They can request to view whatever footage you've got on your camera and you can politely turn down their request. Laughing

Random stop and search? Eh?

A police officer has powers to stop and search you if they have ‘reasonable grounds’ to suspect you’re carrying illegal drugs, a weapon, stolen property or something which could be used to commit a crime. https://www.gov.uk/police-powers-to-stop-and-search-your-rights

They can stop and search you without having reason subject to Section 60 of the Criminal Justice and Public Order Act 1994 which gives police the right to search people in a defined area during a specific time period when they believe, with good reason, that: serious violence will take place and it is necessary to use this power to prevent such violence; or that a person is carrying a dangerous object or offensive weapon; or that an incident involving serious violence has taken place and a dangerous instrument or offensive weapon used in the incident is being carried in the locality.

Those temporary section 60 powers have to be authorised by a senior officer, Assistant Chief Constable or above.

Basically, none of it is done at random.

A uniformed police officer can stop a vehicle at any time without having or giving a reason.

The "reasonable grounds" test still applies to the search part and being in posession of a face they do not like the look of or seeming a little shifty are not "reasonable grounds". An objective reason needs to be present, even if it is fairly tenuous.
