I don't think you would like common sense in law. It wouldn't be you or someone like you deciding what is common sense, it would be some woke social worker from the local council who moonlights for BLM and Momentum.

Um... I hate to point this out but Common Law is "common sense in law" as in the law of precedent. What you're describing is actually Statutory Law - laws of edict and regulation - which is yet another one of those daft ideas we can blame on the French.

It only works if the people passing the judgement have common sense.

Precedent and case-law starts with 5 years training then an indeterminant period of time (decades sometimes) before becoming a judge. Edicts don't technically require any experience although walking into a council executive position with a made-up resumé is unlikely.

Only judges set precedent and caselaw. To be a judge first you have to have been a barrister.

For this reason caselaw and precedent doesn't get.set by magistrates because they are laypeople.
