dude, I am in the same boat.

1) get a balaclava. EDZ merino. all year around.
2) find a helmet that has a correct internal shape (not just size). you're looking for something more round than oval. the first helmet I had was LS2 Arrow bought online, quite narrow oval actually and to make it fit I had to go for M size (otherwise it was just plain painful). then I have looked at the internal helmet shapes more, went through some data and graphs, picked a couple of possible lids, went to an actual shop and tried them all on, and bought second hand Shoei Qwest in my size (S). what a fucking relief man.
3) find earplugs that work in your ears - again a nightmare. I have tried so many of them and most just stick out and get pushed in by the helmet. the least problematic (for me, YMMV) are Happy Ears but sometimes it is hard to pick them out.

This is the way forward. It's a mare if you add glasses into the equation, and this just solves it altogether.

It's against their rules to be circumvented, but the evidence either way is only circumstantial.

I was actually riding for months on my lessons with folded down ears without even knowing LOL

The wife figured it out in the end, I kept complaining at how our comms were quiet, she said hers was fine, swapped units, same, so she moved the speakers a bit, still no different, out of frustration she shoved her hand up the side of my head to see if the speaker was in line with my ear, to discover my ears were both folded over lol

I have since got a different helmet and that must have more ear room as they dont fold over with that one

Another +1 for this. I wear a buff in "ninja"/"old gran" configuration (https://www.youtube.com/watch?v=-mtE8EANyVk&t=34s) so over the head, and up over the chin/mouth this keeps my earplugs in, and makes the helmet slide easily over my head without bending my ears.

Also keeps the helmet a little fresher.
