Well looks like i wont be selling the RXS yet. lol

Way home from work just riding out the T section road. went to go then stopped as traffic was passing. Then some car must have thought I went and acclerated while i stopped straight into the back of me...

(pictures to follow)

The woman a paki with what she claims was her sister in law driving claimed that there was no damage and that we don't have to take it further (bearing in mind the bikes gone 5 meters ahead on its side into the road)

So i tell her take all her details and the other woman driving tell her I wasnt to go through the proper procedue (i've already got a claim number from the police and contacted insurence)
and basically I think shes not insured.

Great so i have a bike with possibly bent rear wheel / swing arm and shocks... and pushed in metal mudguard as you now have to ride the bike at an angle to keep it straight.


Worst Is as i am only TPFT that if she is uninsured I will loose out on money due to this. An it will be a lengthy process in which to get my money back.

However that will take some time and I think you loose the first £300 or so (which may well be more than the value of an RXS100).

So small claims court might be the best choice.

Just because they own most the corners in britain doesn't mean they own the road.
Terrible drivers driving around in their flash BMWs or Nissans.

Same sort of thing happened to me, I got satisfaction knowing the car that pulled out was a right off aswell.
In my case the AA's legal system was great, they sued the driver and got the money for my bike from The insurers beaurough or some thing like that, a part pf everyone's premium is paid into it for such circumstances, don't know if they still do it though.

Agreed.

See if the insurance comes up with anything first. If she is uninsured, ask the police what they are going to do about it (probably nothing at all).

I think it costs something like £45 to take someone to the small claims court and £7 per person to issue a summons. If she is uninsured, this may be the best way to go. You'll need to get some estimates on the damage to determine how much to claim for.

You don't need a solicitor to do this, just go along and tell the magistrate your side of the story.

Chances are she will either pay up when the summons lands or wont turn up and the court will automatically find in your favour.
