Well I found a car in the local autotrader, a 1995 Volvo 440 1.6, which I went along to see last week and decided I wanted it! So I gave the dealer£50 deposit to keep the car and I'd give him the rest yesterday when I said I'd pick it up (it needed an MOT anyway so couldn't take it straight away).

I called up yesterday to make sure everything was OK and that it passed and was ready for me to pick up only to be told they'd sold it to someone else!!!!!

I dunno where I legally stand, but they have offered me my deposit back. I'm so annoyed!

Edit: And to make matters worse I even had all the insurance ready to start yesterday too!

He's offering you the £50 back. That's all he has to do. Did he give you a receipt or anything? IF he did, you may be able to wangle a car of similar value with the same deal. Bit of a bugger with your insurance though.

Not sure where you stand legally. If you signed a deposit agreement, then you probably have a case. But unfortunately in most cases like this, the hassel is just not worth it.

I would take the deposit back, let the seller know your unhappy. Find something else.

You never know, it misght be a blessing in disguise Neutral - probably not

As said above, if you have a signed peice of paper saying its a deposit for that car then you have made a contract.

The seller has broken the contract by selling the car so he should give you the deposit back and any cancelation fee for the insurance as a minimum.

But its a small claims court matter and is fiddly....But just the threat of it may get them to cough up the money straight away. Wink

contact the financial services authority etc for advice, and their HQ, may be worth it...

Idea Just a thought... Or find a similar car and you can change the insurance details for a bare minimum of an admin fee, usually around £30... Idea

and most companies will allow you a short term insurance suspension, too.

The thing is 50 quid deposit is nothing. You could just have easily have walked away and found something else and he may have turned a potential buyer away and had to pay to advertise again.

Money talks and if you were really serious a much larger deposit would have been required.
It doesn't help you because you were a genuine buyer but I'll bet he loses sales all of the time because of timewasters.

The only thing you can do to make yourself feel better is name and shame the garage and hope he loses a sale because of it. Wink

Confused Surely that depends on your own situation, and the price of the car?

In this case I suspect that £50 is at least 10% of the agreed sale price so I think that's actually a pretty reasonable deposit!

The whole point of a deposit is that it forms the basis of a contract. You give a deposit as a sign of good faith that you will come up with the agreed price within an agreed period, and the seller accepts it on the basis that he will not sell the car to anyone else!

Technically this is a breach of contract, and you would be entitled to claim not only the return of your deposit (which he has already agreed) but any other out-of-pocket expenses such as your insurance cancellation fees, phone calls etc but as the seller is well aware pursuing it through the small claims court is a long and costly business and most people won't bother. Even if you don't sue him report him to Trading Standards though.

Anyway, Volvo 440s are horrid little cars and the pop-up headlights always break, you're better off with something else! Wink

I do have a driving licence all be it a provisional but I was insured to drive it with someone in the car with me, which was the whole point me buying a car before I passed so I could learn in my own time without the expense of £21 lessons and would have a car ready for me when I passed too.

Also yes I did have a receipt, I picked up my deposit from the seller before he was very apologetic, it seems one of the other sales guys sold it without the knowledge it had already been sold the day before. And yes it was virtually 10% of the value of the car it was advertised at £595 and I would have got it for £525.

Whoops I meant to say 10%! Laughing

Also I though £525 was reasonable for a 1995 440LE with 80k on the clock with 12months MOT.

On a good note the insurance company will let me change the policy over to another car of the same insurance group or lower free of charge! So I just need to find a new one now! Very Happy

I could "drive" before i started having lessons, theres not a chance in hell your passing your test self-taught.

No I am having lessons too, but want to get as much experience as I can rather than paying £21 for every hour with an instructor.

Plus my dad has agreed to sit in with me, and he's be driving nigh on 40 years.
