Hi,

Just had an off!!

Drove off from lights, making progress when a woman came out of a supermarket car park turning right, blocking my side as there was a queue of traffic on the other side of the road.

Braked... bike went down with damage to the usual suspects, fender, mirror, exhaust, indicators etc

The police were quickly on the scene, took witness statements who all say she pulled out and gave me nowhere to go. And she will be the blamed driver in their report.

The obvious one would to have driven into her Smile but you don't think that quick.

Has anyone had any similar experience of how hard it is to claim her insurance?

Also can I claim for damage to my helmet, gloves, trousers & boots?

Also if I successfully claim her insurance, do I get my excess back

I think you can successfully claim on her insurance, particularly as the police took witness statements saying it was her fault.

CCTV footage? Have you got her registration number? Not sure if leaving the scene of an accident comes into play as I wasn't there?!?

Are you ok though, it may be worth getting checked over at the doctors just in case.

Why were you carrying a guitar with you? Cool

Seriously, you should have no problem claiming against her even though you didn't make any physical contact. The police report will put the blame on her. You can claim for damage to the bike and your lid, etc. (But don't invent damage, 'cos if you are found out it will damage the rest of the claim)

Hi, police report normally plays a tiny role, but not as much as witnesses, and yes, you can claim off her insurance as she created the situation of emergency. Smile

When you replace jeans etc. make sure you keep receipts (sounds daft, but makes it easier for the company to know *how* much to pay out for that stuff).

Hi - Just heard from the police that they have submitted a report against the driver to the PF for Driving with Undue Care.

So that should make it easier to claim!

It also may slow down the settlement if the insurance company decides to wait on the outcome of a court case.

It would probably be worthwhile speaking to a solicitor that specialises in motorcycle accidents to get advice. Not one of those "no win - no fee" ones. I am also not convinced that the ones used by Carole Nash for their free legal services are any better - I had the misfortune to use their services after an accident in 2000. I sincerely believe that they convinced me to settle for 50% blame for their benefit, not mine.

You will find specialists advertising in Bike magazine. A solicitor who is a biker advertises in MAG's "The Road", too.

Hi - Forgot to mention, my leg is in plaster from knee to foot... they say I have a suspected broken toe.

However it is strange that the plaster ends where my toes begin!!

A few scratched and bruises.

The bike is ridable but everything that sticks out on the right is either bent or scratched!

Good point. Try https://www.whitedalton.co.uk/press.php, they seem to be held in high regard amongst the motorcycle press. Also I've heard a few folk on here talking them up.

Your toes go nearly half way along your foot. This X-Ray shows a broken little toe, but its broken inside the flesh of the foot.

Carole Nash put me in touch with my lawyer for my cases through the legal side of my policy. He has been handling motorcycle claims for 18 years and just got me £800 for one crash last year (very dodgy one) and is in the process of suing the shit out of direct line for my second. I think it all depends on where you live and who they put you in contact with. Laughing

Hi - Thanks for the advise, I have legal cover with the insurance cover, Bankstone Legal.. through MCE Insurance. The insurance company says that they should contact me within 24hrs.

Hopefully they are good and can get the claim dealt with quickly
