I bought a 4GB refurbished Ipod Nano from Ebay. Got it today and it was a 2GB version in a 4GB box. It was also quite badly scratched.

Got in contact with the seller and he offered me a replacement. I said I'm not happy with that and want a refund (because I think he is a snide git trying to pull a fast one, although I didn't tell him that). He agreed to the refund.

He charged me a whopping £9.99 delivery by Special Delivery so I said expect the full cost + the 9.99 + 9.99 to send it back to him SD.

My reasoning being that he saw fit to charge that much so it would be reasonable for me to charge the same.

Should I expect to pay to return it leaving me out of pocket?

Although you were somewhat 'conned', I think in these cases, it does best all round to meet them half the way. Regardless if where it may be in the form of principles. My 2P Thumbs Up

Well he's said he'll leave a negative in return for mine. Now, how about leaving a negative one minute before the time period for leaving feedback expires? How long is that, does anyone know?

I'm actually considering riding up to Lancashire to burn his house down. Wink

What on Earth is stopping you just giving him a negative rating? Noone is going to care that you've got one negative rating.

You are abusing the feedback system by not giving him a negative rating. If everyone was like you then they'd be absolutely no point in the system whatsoever.

The seller should pay the postage both ways! It was his 'mistake'.

I've just received a very exciting pair of curtains and the lady send me the wrong ones. She immediately refunded me the cost, the postage and the return postage before I've had a change to return them!!!!!! Thumbs Up

Bloody negative posetive doesnt always work fairly!

You can reply to negative feedback received explaining that it was his cock-up basically. Good idea to as people can usually tell from the feedback who was at fault.

eBay in on the internet and not in real life. If sone says something bad about you, do you really give a shit?
Give honest feedback based on your transaction, then respond to feedback given via the correct channel.

Say you will pay for it, then get his address, and go poke him in the eyes with a tooth pick.

if he resolves the issue you shouldnt leave negative feedback, iirc it should only be left when a dispute cannot be resolved through the normal channels.

there is also a complaint procedure that can overturn unfair negative feedbacks. make sure you have all correspondance if you wish to use this route.
Ive never tried it so i dont know if it works as well as the rest of ebay and paypals policies Rolling Eyes Thumbs Down

Well he's now said point blank he will not refund a penny. Such a pain he lives 250 miles away.

I think I'll just go straight to the Small Claims Court as the paypal/ebay system is a waste of time.

Res, would love for you to go and visit Laughing

Yeah he lives there.

Anyway, trying the paypal system to get my money back. I have copies of emails saying he has the iPod I return, plus my money and no intention of returning it. It should be a clear cut case but I have no faith in the system.

Has anyone else used the dispute system successfully?

Paypal dispute process is balls, they can only get money back for you from the fraudsters, I mean sellers paypal balance. After that they can't do much.

I paid for an item I didn't receive, only got a fiver of the 30 quid back cause that was all was left in their balance. Other people lost a lot more to that seller, I got off lightly! Shocked
