I'm looking to find some sort of letter template to write to natwest (naziwest) and ask for about 600 quid of unfair charges returned to me.

BASICALLY, anyone can do this who has been charged by there bank in the last 6 or 4 years cant remember.

I've been considering doing this.

First Direct stung me for 80 quid one month then 130 quid (I went over again because of the 80...barstards, they love when this happens Evil or Very Mad )

The only concern I have, is if the bank then tell you to pish off and find another bank. Anyone know of this happening? (either with first direct/HSBC or other banks?)

Not heard of any bank shutting anyones account...Yet!

Consumer action group (google it) very helpfull.
I got a few on the go.

Natwest, Halifax (settled) Capital one, Barclay, Bank of scottland.

They will love me soon enough Laughing

I got over £880 off HSBC, MBNA cleared nearly £200 off my credit card as well!

My other half (McJamweasel) got about £400 from Capital One and £100 from Halifax.

It works a treat but didn't half take some chasing. I can see why some people start then give up.

Here's a copy of the letter I have sent today, look at the amount I finally worked out they owe me!. And it was only from two years of statements:


LETTER BEFORE ACTION

Dear Sir/Madam,

ACCOUNT NUMBER: *********
sort code:**-**-**


I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations.

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.

I calculate that you have taken £928 plus £67.48 which you have charged me in overdraft interest for the sum which you have taken. Total £995.48.
I am enclosing a copy of the schedule of the charges which I am claiming.

I require repayment in full of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus a claim under ss.7 and 13 of the Data Protection Act 1998 plus my costs and without further notice.

Furthermore, I shall submit a Consumer Credit Act 1974 complaint to the OFT upon the basis that you have failed to comply with the OFT's direction of 5 April 2006 and are therefore not a 'fit and proper person' to hold a consumer credit licence under the 1974 Act. If you do not understand what this means then seek advice from your legal department.

Have you actually sent the letter?

If not you may want to reword a few bits of it. Also if you are going to claim your charges back I'd suggest you send a request to your bank for all statements going back for the last 6 years.

I told halifax how much they owed me, but that was just over a year.
How ever, When I got my statements back from Natwest, I sent the letter saying how much they owed me. BUt, I now have to send the statements back to them to prove it.
People do give up, but for a couple of hours work its worth it Thumbs Up

you call up the bank and ask them to send that information to you,

they could charge you 10 quid, but its worth it, as you will have proof, on paper which they supplied,

data protection makes them bend over for these type of request,

i will eventually send mine through, if only i wasnt so lazy Mr. Green

Just a warning for anyone taking on their bank for charges - make sure you have another bank account set up before you start. There are reports of some banks closing down accounts after people have been successful in claiming back money.

I'm just about to start mine once they produce 6 years of statements. Thumbs Up

My friend has his HSBC account closed because he reclaimed his bank charges.

Unfortunately the drawback with everyone reclaiming their charges is that the banks are now starting to look at charging subscriptions (I believe First Direct have already written to their customers) for banking services.

Thanks for the above posts Thumbs Up , seems my concerns are valid. Think I'll leave it for now (for the sake of 200 quid) as it's a nightmare changing banks and I couldn't guarantee the overdraft etc FD give me. Better the devil you know, etc.

I may still try to get it back in future though.

I have 3 Bank accounts.

Natwest, HSBC and Halifax.
Halifax kept mine open, with a letter saying if I try to reclaim charges again then the account will be closed.
Not sure what Natwest will say and HSBC is basic so no worries there.
Altho thats the first Ive heard about an account being close.
Ive been with Natwest for 23 years and will be a nightmare if I loose it.
So, be carefull I guess - Not worth the hassle over a few quid Thumbs Up

I didn't realise how shit I was with my finances till I added up the charges and interest on it. still 35 pound every time you go over your overdraft is theft, specially if its by just a few pence. In 1 day I got 210 pounds of charges for useing my card when I thourght my wages had gone in, used the card six times for a total of £32.50. six times misuse = £210 charges. And when I told them what had happened, instead of reducing the charges imposed they increased my overdaft limit to accomadate the charges.
