My company has an underground car park , its in the city centre , a Megane has been left in
the car park for over a year (it appeared a month after I started at this place , nobody has claimed it ,
apparently the owner died of something and fell down the top of the stairs.
Surely theres some sort of way I can claim this as my own salvage right?.
You are supposed to find the owner , try contact them if they don't within X months
you can 'salvage' it for youself, its a 2005 plate car! , and its annoying everybody cus it
is parked just behind the choke point of the car park, meaning parking a car down there
takes forever as you need to get out fold in your mirrors, then edge in , slowly get out
look and edge in.
me thinks it'll make a good vehicle or to sell for a quick buck or if I feel in a good mood something to solve Craig-'s eternal car problems.
Any thoughts?

You will be able to get a key off ebay then get it re-programmed by renault for 1/2 hour labour cost. I'll be doing this in a few days as I lost the keys to my car and I am wondering how much red tape there is going to be  ____________________ NSR 125F > BROS 400 > NC30 > BROS 400 > Trumpet S4 > '97 VFR 750 |

This will make you the registered keeper (with all the associated legal responsibilities), but not the owner.
If you appropriate the vehicle - ie move it, start driving it - basically exercise any property rights over it, but do so honestly, it will not be theft. The Theft Act 1968 specifically states that you are not in law dishonest if you:
honestly believe you have a legal right to, or
believe the owner would consent if they knew of your appropriation and its circumstances, or
believe the owner cannot be found by taking reasonable steps.
Making all reasonable enquiries to locate the owner and get their permission would therefore stop you from being guilty of theft. DVLA will sell you the current keeper details, for a lawful purpose - you can download the paperwork off their website.
This is NOT the same as making you the owner. Very little in English law will transfer genuine title away from a previous owner without their consent. Which means that if someone does turn up in future, claiming to be the owner at the time you took the abandoned car, chances are you will have to return it to them, despite any money you may have spent on it, so be warned...

Some useful info, although I would contact the police and see what they can do, maybe in your benefit, apply to DVLA for logbook, and if the owner didn't die, he could claim it back one day as although you would be the registered keeper, not necessarily the legal owner(I know this may have been mentioned).  ____________________ Roger wrote: Women don't get damp for clingy puppies.
