claiming back money for insurance

Hey guys a colleague at work has mentioned that i should be able to get back the money i paid for my insurance from the third party. Dunno if anybody knows this is true though but when i thought about it, it made sense, basically because

1)the collision was their fault,

2) since my bike is deemed a write off i have paid for a years insurance upfront but have no bike on it (been covered for 1 week when it happened, so i wasnt even out of the cooling off period yet either!).

3) also thought any charges for solicitors etc would be billed to third party right? and since i was insured tpft they had to wait till someone was going to pick up the bill before even thinking about whisking my bike away to be looked at. hence paying a full years premium for my insurers to effectively just make a call to pass it onto the legal team is taking the pee about right?

my colleagues in the process of doing that herself as her car was written off 3 months ago and although shes recieved payout for her car (she was fully comp) shes still paying for her insurance (direct debit) even though there is no car on the policy.

We got hit by a car Feb 06 and part of the claim is the remaining months left on our policy (As the car was written off and the policy cancelled from the write-off date) - We may get it back, we may not but it's part of the claim.

Have they admitted liability? If so you claim from their insurance for bike, clothing any injuries and costs you have incurred.

If your bike has been classed as a write off it is now the property of the insurance company, unless as above the other driver has not admitted liability for the crash. You will have to pay your legal fees and claim them back as part of your claim against the other driver.

She has to pay for her insurance as its part of the contract, if she stops paying the direct debit the insurance company can ask for the payout she received back due to breach of contract.

still waiting to hear back from insurers and was just wondering as i never new that it could be included as part of a claim. Would be interesting (and a pain in the arse) to see him not accept liability though, he was arrested for being several times over the drink limit. Plus he had jumped a red light then hit me in front of a load of witnesses Very Happy.
