Hi

I got flashed about 6 days after i bought my Mito. 28th of February.

(Now i will have to explain why i got the Flash to justify myself to Safety Nazi's)

So.. FAO Safety Nazi's
I got a bit lost, ended up on this HUGE long Dual laned straight road, with a big embankment with grass and trees to separate it from the opposite oncoming lanes. Couldn't see any speed limit signs
So i just thought I'd go as fast as the car in front of me, which was going at least 50mph, which i thought was a bit fast, but it looked like a dual carriageway.
Kept driving along to a point where i could do a U-Turn and go the other way.
When i did, i came back to this road, and thought I'd open it up a little bit, becuase the whole road was empty. Only went to about 60mph though.
Turns out their was a speeding camera this side of the road Surprised
I Went heavy on the brakes, but still manage to get flashed for 41mph.



Anyway, Because the log book was in transit still, the speeding ticket got sent to previous owner, even though it was signed over on the 22nd of February. He Wasn't too fussed about it, becuase it was registered to me.

But The Ticket has just come through yesterday.
As far as i was aware, if they didn't send YOU the ticket within 14 days of it happening, its void, I'm pretty certain i read it somewhere?

is that correct?

They have to send it to the registered owner (at the time) within 14 days as I udnerstand it. Can take 2-3 days to get there if memory serves right.

Go to pepipoo and find out.

Hi

14 days applies to the registered keeper. You were not the registered keeper at the time so they are exempt from keeping to that rule.

I Would have been though, becuase we Signed and dated the V5 papers on the 22nd of February, and posted it later that day. So the DVLA may of not had me down as the registered keeper becuase they were still processing the Log book, but in actual fact, i was the registered keeper.

They are right, you're not going to get out of it.

They send it to the registered keeper. If you didn't have the V5 in your hands with your name as the registered keeper when they sent out the fine then you weren't the registered keeper at that time.

You're not going to get off under the 14 day rule.

But there are plenty of others you can look at, especially as you say you didn't see any signs.

So - are there any limit signs? Are they of the correct size and shape? Are they placed at every approach to the road where the limit is different? Are they spaced at the correct intervals? Are they lit where required? Are they obscured? I take it that it was a 30 limit (as you got done for 41), in which case repeaters aren't necessary if the streetlights are placed at the right distance apart. Check.

If the street has streetlights then there does not to be any speed limit signs, anywhere.

The limit is 30 on a street with streetlights, unless otherwise stated.

There still has to be signs at the entrance to the 30 limit zone from a zone with a different limit.

DVLA can take weeks to process anything, let alone 5 days minus postage time. Earliest working day they would have had it was the 26th. Obviously as it was sent to the previous owner that is the info they had at that moment.

Although the scamera units may be working off an older list of the owners.

If the DVLA had processed the change of keeper when the NIP was issued then it would have landed on your doormat and not his. So at the time they still considered the other guy to be the registered keeper and hence they issued the ticket within 14 days.

So they did their bit correctly and because of the circumstances and the need for the NIP to be returned and reissued to you, the original 14 day rule goes out of the window.

Like the others have said you won't get off on that rule so if you feel the need to fight the ticket then you will have to look elsewhere for a technicality to get off on. You could always just pay up and accept the points seeing as they caught you fair and square... Neutral

Nothing to do with safety, its your lack of knowledge about speed limits and poor observations that have let you down. There is no wriggling out of this one, they have got you fair and square. Consider yourself scamera fodder. Wink

Alright thats Fine

Im not bothered about the points, because i know poeple who know people that can get these sorta things wiped. Costs £120 though.
Have too many points as it is.

EDIT

Like i said, it was the fact that cars around me when i was heading up the road where going alot faster than 30mph, it was rather odd to find a camera on the way back, USUALY both sides of the road have camera's

I know plenty of roads with a camera on one side, plus a few where they sporadically turn the camera around to face the other way... so you never quite know until close up!

As for signing the docs and sending off making you the RK... You aren't the RK until the DVLA say you are. They are the ones that register you, not yourself signing it and sending it off.

Think you may just have to lump it sadly mate.

Usually there is nothing coming when i cut this corner"sorry i killed you"
there is no "usually" out on the road,you have to know the rules,see the signs and make decisions.
if you can get points wiped for £120 you could make a fortune.
whats the problem?

well like i said, usually they are, but im not denying the fact there are places where they arent.

Point i was making, i dont usually ride around like an idiot, bouncing the needle of the limiter everywhere i go. Just got caught out on this occasion.

Ye someone probably does. I Dont ask many questions, Just pass over the ticket, pay the money and it disappears.
