One of my mates recently got done speeding, not by a camera but by a copper with camera. (if you know what i mean), anyway he has been trying to get out of it using somehting called a pace document, anway on the way back from training he got done again by a copper with a gun, he was asked to pull over, and then the usual. he couldnt get out of that one, now he faces losing his license because he is within the first 2 years after passing his test.
Is there anything he can do to get away with it???
any help would be very very much appreciated.
i will give any information needed to help any ideas.

yeh maybe.....he isnt renowned for hsi great or safe driving. but he is still my mate so, would be useful if there is any advice i could give him. i said about using a dodgy speedo. saying that the speedo was out. only problem is it would have to be out by about 13 mph.....

Speedos by law must be within 5% accuracy, if he tries that one they will say the bike was not roadworthy and he knew this.


If you mean by the pace doc he got a fine through the post and had to declare who the rider was, he has a chance. If he was stopped at roadside, it won't work.

I take it there was 2 officers present both times? 2nd officer must coroborate the speed.This means that if the other officer was even dealing with another motorist at the time he cannot be done.

If it was an officer with a gun both times he should have been stopped at the scene both times, did this happen?

its a car, and first time he was caught by a camera but wasnt stopped. Seocnd time with a gun but he was stopped.
There was only one copper present on both occasions.
the speedo could have passed mot but fucked up somehow during use, how would he have known? but i can see how that might not be a good excuse.

Pace letter might get him off. If he is prepared to go through with it and knows that the police are quite possibly going toplay dirty (eg, turn up on his doorstep at 4am demanding a statement).

Speedo accuracy is a lot more varied than 5%. It isn't checked in the MOT.

Best tell him to get onto Pepipoo, but with 2 speeding tickets in the system he will be lucky to get away with it.

Speedo accuracy legally can be a fair way out.

3. Conformity of production

3.1. Conformity of production will be checked on the basis of the provisions of Annex VI to Directive 92/61/EEC.

3.2. Production models will be considered to meet the requirements of this Directive if, under the conditions referred to in items 2.3.1 to 2.3.6, the relationship between speed V1 read on the speedometer and actual speed V2 is as follows:

0 <= (V1 - V2) &lt;= 0,1 · V2 + 4 km/h for mopeds,

and

0 <= (V1 - V2) &lt;= 0,1 · V2 + 8 km/h for motorcycles and motor tricycles.


So they can read high but not low. For homologation they can be 10%+4kmh high, and production bikes (but not mopeds) can be a bit less accurate.

Only tested at a couple of set speeds I think. But at an actual 120kmh / 75mph the speedo could legally read 140kmh / 87mph.

Directives seem to be 75/443/EEC for car speedos, 97/39/EC which updates that, and 2000/7/EC for bikes.

Pace defence may work on gatso, but if a mobile camera danger of pic of driver to consider. However he can ask for a copy of it if pleads NG.

2nd one I would be questioning the fact only one officer was present with the gun,if that is the case it won't stand up in court imho

Yes it will. It is the corroborated opinion of a police officer. The speed gun counts as corroboration, just as would the opinion of a 2nd officer.

Unless you're in Scotland, in which case you need two police officers.
