Hi, i got cought speeding yeturday evening was told i was doing at least 115mph in a 1.6 focus (yeah right). I was doing nowhere near that. I was pulled by a marked T5 with two officers in which must have been hiding on a slip road. I was given a fixed penalty notice 3 points and a £60 fine. The officers told me they had me at an average of over 90, i know this to be rubbish because i saw them coming behind me and was down to 70 before they could have took an average. Plus my road angel never went over 90 nor did the speedo. They told me they were doing 135 to catch up with me so how they could have got an average speed of 90 is beyond me if the two vehicle speeds were so different. This was on a clear two mile stretch of carrige way with no other cars to be seen, dry and light conditions.

I know as there were two officers in the car so bassically i stand no chance even though i was shown no evidence and was told they have no video evidence. My word against their's.

I showed them my Licence at the roadside, so does this mean i have accepted the FPN and cant contest it?

My main question was, when i go to the police station to produce my documents will they take my licence there and then? I have a trackday next monday where i need to produce both part of my licence to take part so i cant really hand it over but its over the 7days to produce. Would it be possible to produce my licence as proof i have one then take it back at a later date, as i have 28days to pay the fine? Im sure the trackday company wont accept a temporary licence as proof so may be a bit suffed?

Thanks for any help.

Hi Beans. Bad luck on being caught.
It is usual practise that you are invited into the car and shown the data they have measured your speed. From one point to another and usually exceeding a mile of carriageway.
You have not accepted the fixed penalty at this stage.
The ticket they have given you, clearly explains what you can do if you wish to contest the crime.
If you accept the charge, you will have to surrender your license within the seven days and pay the fine within the 28 days. You can not retain your license after producing.
The only possible get out of jail clause would be to attend the station and tell them you have mis-placed your license and need to apply for a new one and see what there response is.
If they accept that, hey presto, you have your license for the track day. Hope this helps.

Or you could appeal.

Then i'm guessing that it would go to court and you could battle it out with them.

With them having no evidence at all i think you would have a good case.

Then you will have to apply for a new one as if you turn up and hand in the old one you are in deep shiyte as you told them that you lost it. Don't think suddenly finding it will work, they would have heard that one many times before.

Photocopy your licence and ring the trackday people and tell them what has happened and ask if they will allow a photocopy.

Hi

For advice on the ticket go onto Pepipoo.

As to the track day, ring the organisors. They are probably very used to people forgetting their licences. Some will ring the DVLA to check you have a licence.

All the best

Keith

Cheers guys, Ive posted on pepipoo but It looks like theres nothing I can do. Two officers in the car so it my word against theres, its obvious who a court would side with. Even though the officer was talking shite, he told me my exhaust was popping as it cooled because id been thrashing it (nothing to do with the fact id been driving an hr and a half) Also pointing out my tyres were warm because I was going to quick again nothing to do with the nature of tyres heating up when you drive.

The tackday is booked with focussed events for Monday at snetterton, does anyone have any experiance with them accepting photocopys of both parts of the licence?

Does anyone know if when I surrender my licence at the station I will be given peice of paper to say I have a valid licence and if focussed events will accept this?

Thanks for the help.

I didn`t mean for Beans to suddenly turn up with his license. Genuinely say it`s lost for the producer, but then has it in wallet for the track day, then disposed of.

but you were speeding right?
ok you didnt do 115 but you stated by the time they caught you up you had dropped to 70.
two experienced officers in a traffic car is usually enough to get a conviction.
3 points and £60 isnt the end of the world.
contact the trackday company and fax them your license explaining that it has to go away to have points added, shouldnt be a problem.

I got a fixed penalty for doing 55 in a 40 just last Wednesday. I handed in my licence to the station, they took it off me and filled in the section at the bottom of the penalty notice with my licence details. The lady told me that the notice would now serve as my licence until I got mine back after paying the fine.
The slip contains your licence number, your address, the cateogires you can drive, the issue & expiry date and the type of licence (full/prov).

Basically you need to ring up the event organiser and ask them if they will accept it. Aside from the photo, the slip has all the information your standard photocard would (which is all I've ever needed for trackdays). They may well accept the slip, or if not they can take the number and perform a check against it.
The slip is signed by a police officer to acknowledge that it counts as your licence, so I don't see how they could refuse to accept it.

Well if you are so sure that you weren't doing that kind of speed as an average contest the FPN and go to court instead. Then they will have to disclose exactly what evidence they have in order to gain a conviction against you. But I would only advise you to do this if you are confident that you were not speeding at any point where they could have been behind you.

Im sure they weren't behind me when I was speeding but I will just take the points and fine as im sure as there are two of them they dont need evidence. Never mind ill just have to put it down to experience.

Anyone else at the trackday at snetterton on the 4th June? Hopefully ill be there aslong as I can sort the licience thing with them.

Would the fact that they've written the wrong sex on the ticket make any difference?

Surely the ticket is invalid in this case?

You can't just write "fe" infront of male and hope they don't notice that you've used a different pen Wink

Hi,

Ive just taken my documents inc licience up to my nominated police staion. The FPN and all documents were taken off me for about 15mins to be processed and then handed back to me along with my licence and all other documents. When I asked if I could pay the FPN there and then I was told I had to send the money off to the payments office.

The thing that has got me is that I got my licence back clean with no points on?? Is the normal and if so will I have to send the licence off to have the points put on? None of this was mentioned to me as the guy who delt with it was a Community Support officer and said he was covering for somone else. I was given a piece of a4 paper (statement of witness) to say I had produced my documents but no mention of points being added?

I would think you were given a producer and will also get a NIP through the post soon. Then you send the money and your licence off DVLA so they can put the Points on.

Have you looked on PePiPoo yet for any info?

I was definetly given an FPN as its got all the information on the slip to pay with and was also told by the police it was an FPN. It says on the back of what ive been given to send off a cheque and not my licience. Confused
