Id declare it sorn as this should freeze the MOT if you do ever get it back shoudent it?

Assuming you have reported it to the police, i would just inform DVLA that the bike has been stolen, and you no longer have it.
Might need you to surender the V5.

And send that recorded delivery. They will screw you at any given opportunity, that means a fine for 'not receiving it'.

I can't do that, because I'll need it if the bike turns up won't I?

Obviously then I'll need to MOT and tax it, but surely while it's not in my posession it's not my responsibility?

Just give the DVLA a call and see what they say. At least then they can't say that you didn't get in contact to inform them of it. Be sure to write down who you spoke to and the info they gave you (if any). They can be surprisingly friendly/helpful when speaking on the phone, or have been when I've spoke to them anyway.

No you don't, as long as it has been reported as stolen the Police will have told the DVLA

You should have a crime number, any hassle over the bike supply the crime number - it's your proof the bike is no longer in your posession.

You don't need to surrender the V5c, in fact bang the crime ref on it and keep it safe with your other vehicle info.

DVLA will inevitably send you a tax reminder - just do what I did and call them to confirm they have the crime ref.
