more insurance woes

Semi rant and semi query this....

Well the ongoing fiasco that is my insurance claim against mr drink driving who was potentially going to be uninsured van man gets more annoying and frustrating.

His insurance decide to cover him after 2 months of arguing that they should of told him his payments stopped coming out and they cancelled his policy. Now they then proceded to take another month to look at my bike and then offer me a crap value for it.
So i did what most people in my situation would do and gathered a bunch of reciepts, adverts and things to try argue the toss over the crummy value they gave. however its taken another 3 weeks for them to turn round and say "no" even though ive given them evidence that their value was a joke. So now BLD who was helping me get the money back for my bike have just fobbed it off onto my solicitors (provided by insurers again) to reclaim the "outstanding losses".

So whats the likelihood they'll be able to get them to stop being c*nts? Anyone been in a similar situation, whats gonna happen? They've still yet to accept liability which is odd as everythings against the drunken bum who hit me, witnesses, police, his DUI charge etc. But they are being billed for storage and any other charges by BLD. Anyone got any advice would be much appreciated. Cheers

If they refuse to stop behaving like criminal fraudsters you'll have to take them to court. Your solicitor will arrange that per your instructions.

Issue proceedings!!!!

Most insurers will take their time and do whatever it takes to reduce their costs and payments, but once proceedings are issued they have to comply with a very strict time frame, and it will show them that you are serious.

Insurers to a certain degree are obliged to pay you the cost of replacing like for like, but they will often try and get claimants to accept a lower value as again this reduces their outgoings, and if someone accepts a lower valuation then they will have suceeded in achieving this.

Your solicitors will be able to get proceedings moving, and usually once this happens the third party will pull their finger out as costs will spiral once it starts going to court which they will want to avoid.

Additionaly, make sure that all your out of pocket expenses are claimed for, along with any damaged personal equipment as they are obliged to cover this cost as well.

The only time when this procedure can take longer is where there is the liklihood of contributory negligence being alleged, which in the case of a Drink Drive is unlikely.

If you are not happy with your current law firm, then tell your insurers that you want to change, and even tell them that you want to choose your own firm.

However, regardless, if you are on LEI, once you have proceedings issued, you can choose whoever you want and your LEI would still be obliged to cover you and pay your new firm.

Cheers guys, i've been confused with who should be sorting out what as i've been dealing with 2 firms both provided by my insurers.

Bikers Legal Defence I assume was sorting my bike out, they came to pick my the wreck up for assessment and deal with the third party and kept trying to offer me hire bikes and such, however i could also use them to claim back my financial losses too.

Then I was also appointed a solicitor which i assume is dealing with my injuries and also financial losses.

So who was i supposed to try claim my damaged kit back off?

I gather with BLD now passing everything onto my appointed solicitor that they should be dealing with everything? Would it be down to me discussing with my solicitor to issue proceedings? Also whats an LEI?

I've not been too impressed with bikers legal defence since they switched the person dealing with my case. The girl i had before always rang to keep me well informed what was going on or try offer me a hire bike, the new dude i have to keep chasing up.

Solicitor isnt so bad though will switching to something like rider support actually be any benefit? theres no info on their site.

LEI is Legal Expenses Insurance. It is a means of insurers making extra money from policyholders as not only do they normally charge for it without tellingn you within their premiums, it also means that they will appoint solicitors on your behalf, often working at a fixed rate well below those firms who do a decent job.

LEI in 99% of cases is a waste of money as you can usually get a better service from solicitors of your own choosing under a no win no fee (or Conditional Fee agreement to give it its proper name).

Your claim for everything is against the third party and his/her insurers, and your solicitors will do everything.

Most accident management firms are a third party firm who simply make money on the back of hire bike costs, replacement clothing and the like. At the end of the day only a proper law firm can move things forward.
