PostPosted: 11:21 - 15 Jun 2007    Post subject: NIP/PACE Witness Statement. Reply with quote

Hi all,

I have recently recieved a NIP through the post. Now a have been on pepipoo and completed the NIP wizard. It is now suggesting that I complete the PACE witness statement form, now I have looked around but there seems to be no information stating clearly what happens when this is used. Quite simply Im asking for your help on what to do. Take the 3 points and 60 pound fine, or use PACE and try to escape?

Thanks in advance for any help.

I don't know. His picture just made me angry.
I think it might be the backpack.

Play the system!

I didn't use PACE just said I didn't know who the rider was which stalled it for a couple of months, then I admitted it was me and filled in the NIP, then I never received a court letter. Had I just sent the original NIP straight back I would've lost my license on that one (67 in a 40). The more work you make them do the more likely they are to mess up and forget about you. Send the PACE statement, at worst you'll go court get the standard fine plus £40 court costs, it's worth the risk.

All the info is on pepipoo that you need, be prepared for a long slog and if it goes to court you may lose and get costs.

Oh and you want to get your elbows up a bit. Wink

Play it and see where it gets you, I did but unfortunately they summons me for both the speeding and s172 (not providing details of driver) on the same court appearance. I would have had to incriminate
myself on one or other charge. I strung it along until the last minute then pleaded guilty by letter to the speeding to take the 3 points and £60 fine. Still had to go to court and the magistrate gave the camera guy a mouthful for wasting the courts time. I still had my 3 points though but no costs apart from the £60 fine.

Give it a go you can always change your plea if you don't get anywhere.

And the gun is aimed at the top of the tyre, which if it manages to return a reading is going at twice the speed of the bike relative to the radar gun.

All the best

Do they censor out plates of other vehicles and faces of passersby on those photographs? Thinking

I have had a few nips now and have often wondered about going down the PACE statement route....but when I looked on pepipoo, it seems that the majority of people dont get away with it...and end up paying more than the original 3 points and £60 fine offer, by getting charged for witholding information too.

Whilst probably sounding stupid, I am confused as to how they knew it was you toby? Surely the lack of front plate meant that they couldnt trace you?

That can't be sychdin speed camera , because you were traveling to wards mold , that is for sure as it can see your plate, it can only see your plate if you were going in the mold direction , not the northorp direction, to the left of the camera is a bus stop , clearly there is not a bus stop in that picture.

I will get a picture of the camera next time I am down there to prove this.

Yep

Got pulled at the side of the road as I went past, picture was printed off as I got off of the bike and they handed it to me and gave me the whole speech at the side of the road.

Sad
