Just got back in from doing some shopping and whilst out I had a minor bump. I'm after some legal advice into who was in the wrong, I just want to know so that if it was me I can avoid doing it again.

Below is a picture of the road I was on.

I was travelling in the direction indicated by the red arrow, down a hill. The traffic on my side of the road was backed up about a quarter of a mile and was stopped by the traffic lights at the crossroads as indicated by the yellow arrows.

I decided to filter down the outside of the traffic and started to slow as I approached the yellow cross hatched markings on the road. As I slowed I noticed a car indicating right to pull out as indicated by the blue arrow.

I stopped my bike where the green dot is and waited expecting the woman to see me (her car was gently rolling forwards) however, she was looking left and not at me.

She continued to roll forwards and hit me whilst still looking left. She wasn't going that fast and only took a tiny nick of paint off my front mudguard. I moved my bike and and she shouted at me (out of shock I think) but then calmed down and I made sure she was ok.

We both went our seperate ways.

I'm not after a lecture or anything, I just wondered if I was in the wrong for filtering. My bike was stationary when she hit me and she wasn't looking in the direction her car was moving.

You shouldn't have entered the cross hatchings unless your exit was clear. If you were moving, I'd say she was in the wrong, as you had right of way.

As is, she hit a stationary vehicle, though, you weren't really supposed to be stationary there....

Would be interested if there's a case on a similar incident though. Smile

You were ok to filter if you felt it was safe to do so. Your mistake was stopping in the yellow box, So you were at fault, Sorry Embarassed

Her mistake was hitting a stationary object though.

Regardless of legal fault, a quick brush of your horn would have probably prevented the situation if you had seen she was rolling forward.

I only stopped because I seen her coming, I would have kept going if she had stopped.

As for my horn, it all happened that fast. Never mind, we live and learn Thumbs Up

I personally would have filtered up until the point of the box and waited for traffic flow to resume, I dont filter where there are junctions theres too manyvariables.

I would say 50/50 to be honest

From everything I've seen regarding filtering its a 50/50 split.

She should have been paying more attention but you shouldn't have been there.

At least the damage was only a little paint transference
