So, my ex has given me her word and been very honest from day one with the loan.
It was the only way we could sort our finances back then.
Before you have a go at me, yes i know i was stupid not to get it in both names, but at the time i wasn't thinking like that.

So i have X amount of loan, she had one amount i had another, she had less than me but we decided to pay off the same amount each month at first and then when it got down to what was left of mine, she'd stop paying. Hope that makes sense.

So what are my options?

She can't get help from her mum or any family so it will have to come from her.
My idea was to go into the bank, talk them through whats going on, and hopefully they'd help me work out what we both have left to pay.
Then she can apply for a loan and see if she can pay that part off.

Any advice welcome...

K Thumbs Up

Hi

Well as it appears you realise you are the one actually liable. You plan of going to the bank seems like a good one.

I say they should be helpful enough. Was in the same situation myself.

Killa, you should be able to find out how much is outstanding + any settlement options over the phone. it should take seconds.
Do you have online banking? it will be on there.

Depending on your relationship with your Ex, you could offer her some leniency, e.g instead of finishing xx months early she could pay xx less per month but it will have to be paid over the full term.

Call the bank and get a settlement figure from them for the loan.

Then comes the maths bit. Work out exactly how much you've both individually paid off and how much each of you owe.

Then go to the bank, armed with your facts and figures (your ex will have to do this as well) and explain the situation. They will be sympathetic.

Your best bet is then to get two individual loans whereby you each cover your individual liability.

That's what I did...OK, I'm still paying it off, but it was worth it as it made life much easier. Thumbs Up

get something in writing signed by her to say she owes you the money, as if the loan is in your name, you owe the bank and she owes you for what part of the loan she had.

I leant my ex money and at first she was good about keeping up payments but then she decided that she couldnt as she didnt have any money.

I think if she spent less, she could pay me.

I really should get the law on her ass, but i keep thinking it will sort itself out.

I need to dig out the bank statements that show the amount loaned, and the payments that she was making and then i could get the law on her ass.

Get something in writing before you grow apart.

But if she refused to pay it(the money she lent and used), wouldn't it be small claims court case, rather than pleading sympathy with the bank?
