Is it an MOT failure to have a kick start which doesnt return back to its original place and if it is then how much would a garage usually charge to fix it.

If you want to know its a rsx 100

*Got it started today and i am VERY happy Very Happy*

no i don't believe thats a failure.
if you get any hassle about it, remove it. and bump start it.
i cant imagine any one would bother hassling you about it Very Happy

the kick starter just returns on a spring. mabee the spring has come out of its hole on the shaft, or broken.
pull the kicker off, then the cover. you'll see the spring under the cover
