CBT - max engine size is a 125.

Or do you mean taking your DAS on a 33bhp machine? Wink

Erm no... if you could we'd all be doing it.

You have to take the A2 license to do that.

CBT allows you to ride anything upto 125cc (11kw / 14.6bhp)

No, I'm afraid not. 125cc and 14.6BHP is max permitted on a CBT. Restricted Licence (A2) and you can ride upto 33BHP any cc. Full Licence (DAS or 2 yrs at restricted) and you can ride a bike with any amount of BHP and any cc engine.

Hmmm. Worth a try I guess.

Does that then mean that me brother who has had his rs125 de-restricted is riding at 33bhp?

Therefore is being illegal?

illegal? absolutley.

Chances of being done for it? Minimal, unless he's really stupid and hacks it past a copper at a speed his bike shouldn't be letting him do.

You will find your wrong in that quote. You can do you CBT on a 400, i did mine on an ER5.

After taking CBT and the theory test, the practical test may be taken on a motorcycle with a power output of at least 35kW. A pass allows you to ride any size of bike. All or part of the CBT course may be taken on either a learner bike or a large bike. You may practice for the practical test on bikes larger than the learner bike specification provided:

you are accompanied at all times by an approved instructor on another bike and in radio contact
you wear fluorescent or reflective clothing and follow all other provisional licence restrictions
