....and i was doing so well!!

Riding to my sisters last night through town, i've come across a cross road to some traffic at crawling speed. Filtering at what i guess was 20-25mph when all of a sudden someone flings open a car door! Surprised
I hit the door pretty hard and the 7R took a lot of the force, as the slow mo insued pieces of fairing flew off all over the place and then the final crack and slide down onto it's side.
The impact sent me off the bike in the same direction, my legs were away from the bike by the time it hit the ground, but i think i was still holding on to the handle bars. When i hit the ground i had braced as much as i could for the time given, i got up using press up position and back on my feet.
Obsenities followed at the occupants of the car, they looked pretty stunned at what they had just seen.

So damage to the Kwak as far as i can see is...

Front fairing
Left fairing
right fairing
indicators x2
mirrors
screen
brake lever

Damage to Killa

Bruised shoulder
Badly knocked knee (its my bad one so keeping my eye on it)
Bruised hip
Weird browny purple bruise on my finger Confused

Crying or Very sad Poor thing

Couple of things...
It was a taxi, the occupant in the rear (drivers side) opened the door without looking. I know he's liable for that. I have all of his details and two witnesses, just wondering what the first few steps are.
Was going to call my insurers this morning and pass on details, i have a police incident number to.

Awwww shit, Killa. That sucks.

Do you have the cabbie's insurance details? If not get down the office and ask for them, it will be quicker than getting your insurance to write to them.

Get yourself checked - at least by the doctor. That way injuries are logged somewhere and will form part of the claim

Other than that, let your insurance sort it.

Oh, and take it easy and chill a bit. Rest the shoulder and hip.

Yeah i got his taxi number, reg, phone number...everything.
I'm getting on the phone in a bit.
I went to the hospital last night because of the knee, he says i've just knocked it pretty hard, so keep using it and keep and eye on its condition. Thumbs Up

Just out of interest, I asume a cabbie insurers are responsible for the actions of the fares? I know they say that if you get a private cab that is not booked through an operator then your not insured?

So if your not insured what would happen in an event like this?

Do this. Now.

Just go in, say "I've been in an accident, I want a doctor to look over my injuries and record them"

Also, next time slow down / cover the brake when filtering past taxis. Not only do doors suddenly fly open, but drivers are quite fond of doing sudden U-turns if they encounter traffic or have just picked up. Karma

I've got my rear brake covered all the time, but in this case the door opened about half a second infront of me before impact. I had no chance for a reaction. Thumbs Down

To be fair, I also said keep the speed down. Hey-ho. Razz Most of the close shaves I've had where there's less than a second to act have been avoided by a neat swerve by quick countersteering, rather than trying to stop. I didn't think about it; it's just some instinctive avoidance manouevre. Here also, a lack of speed does help immensely. Thumbs Up

Looking at the first photo, things didn't look too bad. But then I scrolled down and saw the second pic and seeing the bike in that state actually made me feel quite sick lol!

That is both unfortunate and nasty. Your 7R was lovely, always loved the foxeye Kwak, especially yours since you don't see many in black.

Would have thought you have a pretty cast iron claim there, so I would be getting it fixed by professionals at no expense spared. Thumbs Up

To be honest speed is not really the issue here, as long as bikes have the benefit of filtering accidents will continue to occur. We all know the risks involved, and try to manage that accordingly. Though each case is judged on it's unique circumstances the judge's comments in the case of Davis v Schrogin CA (Civ Div) 27 June 2006 are a legal precedent I'm happy to lean on:

...a filtering motorcyclist passing stationary or very slow moving traffic could not be to blame if a collision occured if the rider had no chance to take avoiding action.


Interesting to note that Davis' speed was judged to have been 40-45mph in the wet whilst passing stationary traffic. It was Schrogin performing a U-turn whilst wound-up that caused the accident, even though he indicated his intention.

Am I the only one who laughed at the comedy value of this before starting to feel sorry for Killa? Car door opens in front of you and you've got no chance to react. That's something you'd see in a film, not in reality! Laughing

Glad you are OK (ish) looks like most of the damage to the bike is cosmetic and with a new brake lever she will be ridable.

bugger. sympathies to you. sounds like you got away reasonably lightly tho (altho I'm sure it doesnt feel like it) cor door corners have been known to do some serious unpleasantness. BTW check you front wheel spindle and bearings. The bearing in particular may well have dinks in.

If that dent in the frame happened during the crash it is a scrapper.
I hope that the manufacturer put it there rather than the bars.
I do have some feelings for the cabbie though, it was not his fault that the chimps in the back opened the door and he will now be without a means of making a living.

i hope its not a private hire as i was in an accident with one on the 1st of august (he pulled out infront of me at a roundabout, without giving way) and it still isnt resolved. Grrr.

Fire-Nsr on the forum also had a run in with a taxi aswell recently.
