cant find anything on google to help have a quick question;

if someone leaves something in my house for a year and dont come and get it when they have been told to and have no room for it thinks i am a storage unit is it legally mine after so long? this is not bikes or cars we are talking about its the contents of my spare rooms and attics. dont want to get to much into it this person is being an ass about things. And wont come get it but says its still theirs and expects me to hold it free of charge.

if there is no law its out on the street.

List the lot on ebay, if they want it they can buy it back and then you can keep the cash for storage fees.

Or list it on freecycle, it will be gone instantly Laughing

Thought about that but then felt bad and maybe i can be sued or something dont know thats why i need to know where i stand with the law. i mean they would look stupid phoning the cops and saying i have their things when i have lived here for over a year now and they havnt.

If you were a landlord and a tenant left, leaving crap behind, then as landlord you are responsible for clearing it up. The fact they don't have room for anything is not your problem. I'd send them a registered letter requiring signature, giving them a week to remove the items, stating that unless they are collected then they will be disposed of. Seems to be the standard that councils treat tenants who have left stuff behind :-

https://www.moray.gov.uk/moray_standard/page_1300.html :-
Quote:
Abandoning your home
We can terminate your tenancy if we have reasonable grounds for believing that you have abandoned your house. In this situation we can forcibly enter your house to make it secure and serve on you an Abandoned Property Notice which tells you that we believe that you have abandoned your house. This Notice requires you to contact us on or before the specified date. If we do not hear from you by then or we have reasonable grounds for believing that you have abandoned your house, we can terminate your tenancy by serving a second Notice on you.

After this, if you have left any of your property or possessions in the house, we will tell you about what is left and the procedure for reclaiming it. We will store belongings for at least 28 days. Where belongings have a value of the equivalent to the costs of 6 months storage, they will be stored for 6 months. You will be recharged for storage costs. If you do not contact us to reclaim your property, we will dispose of them.

have to explain now, see the stuff is my brothers stuff nothing to do with landlord he just likes to use poeple and be nasty and i dont want it here. I will compromise if he lets me use this thing. its a stupid xmas tree and about £3000 worth of lights, i only need a lend of the tree cause i dont have one and he dsnt need it and he wont take money for it, he wont move it, and wont let me use it. so i dont want it in my house anymore except my parents already have his crap lying in their halls cause they cant fit anymore in.He is nasty and spiteful says he wants it but dosnt come and get it???? Shocked if thats the case no more free storage form me. my rooms could be turned into guest rooms for when my mates get pissed and stay instead of his crap in them. need some back up for this also. its not property of stuff left that is unclaimed the claimer wont lift it so need to know do i legally own it still since its been here a year now and not moved.

if i used the tree (a bloody tree like) then what can the cops do cause he would call them out of spite Rolling Eyes
i would laugh at someone if they done that.

Just tell him you need the room and he has to come and get it or you will just leave it outside.
Or tell him that he either takes it away or you will sell/give it away and give him 50% of what you get, the rest is to cover expences.
Or just load it all up and dump it at his address.. Not got much choice then has he.

Don't think the police would be interested as its a civil matter.

if you are worried about it, then send him a letter by recorded delivery stating that he has 10 days (or however many you choose) to remove it or you claim it as your property. keep a copy for yourself and the recipet from when it is signed for. that way if he doesnt get it you have proof of giving him a written warning which would be all you need.

think about it, if you find a wallet or hand bag or jewelry and hand it in to the police..if no one claims it within 6 months you get it back! so it seems that even the police only hold things for 6 months.

tell your parents to do the same, he either shifts his shit - or it all gets sold and you are keeping the money.

WTF? A three grand xmas tree, you say? I'd have that fecker on ebay quicker than you could say "Nigerian scam artist".

Now, repeat after me: "Sorry bro - didn't you hear about the burglary?"

No the tree is an 8ft one now 3 grand lol the lights that he bought cause he is obsessed with Christmas for the exterior and interior of the house come to about £3000 half of B&Q lol. ps he is in 22k debt that was part of it, he has issues. After listening to a conversation he had with my parents while i was on the phone listening i was about to trash everything belonging to him as its not my responsibility. I then decided after hearing him snipe, bitch and yap that he had to pay for stuff when i was here like his own food that i was taking the dam tree as compensation and not paying him for it when its in my house anyway. Dad said i could sell it and give him the money he said as long as i didnt get a penny, then dad said we will sell it and give her in and answer was NO! pity mush fuck you sis.

my mum told him he lived in their house for free dosnt pay a dam penny so dosnt have a say in what goes where. Turned into me loosing the rag and dad telling me to calm down. My parents are on my side they dont want the stuff his stuff is still in their hall and they have no room for anything and he wants all the rest of it there. He is an unemployed dole scrounging chav who pays for nothing!and wont get a job turns his nose up at everything, and i feel sorry that my parents have to deal with that until the end of their time. I will end up with both them if something happens to my parents as my other sis has severe autism and he cant fucking wipe his own arse. (he is nearly 30 years old!)

I dont want to go into my past with him there is some threads about here with me ranting but i did kick him out as he tried living without his parents and lasted 5 month of which he got sacked form his job, didnt wash, ate all my food and didn't pay bills then throws it in my face that i asked him to leave as i couldn't afford to look after him while he partied in clubs and scrounged of everyone he knew. now gets everything for free again and has a bitch about me asking him for bill money to my mum when he lived here

has some serious issues, i don't want this to get nasty but there is no other way with him. no compromise, well he will have to like it or lump it cause i would love to see him get in here to get the tree out of my room when i put it up. my dog hates him anyway! growls at the sight of him. bad karma there.,

if any of you knew him he you would actually want to kick his shit in and guess what i ain't protecting him against death threats anymore from his enemies he deserves what he gets. (prob just a good kicking) he is a major asshole all over,a good few want words with him and i am not intervening ever again, he needs to grow the hell up.

So, got an address? Can come and remove all his belongings...in time for sundays car boot.

And for a small, fair fee we can remove him as well...

On a more serious note, ive met people like that before and the best way to deal with them is for everyone to co operate together, give him one answer from everyone.

If you and your parents both tell him the same thing - get out, get rid of your stuff or we will sell it and keep the money, he probably will. Its when one of you makes a small mistake, like one of you arguing and saying "We'll see what we can do with the tree", or "We might give you a bit of money" - he will take it as being in his favour and carry on arguing for it putting you back to square one.

Eventually, he will exhaust all of his friends - they wont take him in, he will exhaust any favours he has outstanding, and eventually he wont have a choice but to get a job - or be taken to court due to his debt.

Pretty much, put him out on his arse, dont even humour him - pretty much disown him till he comes back with a head fixed on straight and can discuss things properly.

See my parents fell for the "we will see if we can get you cash for the tree" that was until i heard what he said (above post) now he can whistle for the tree and its decs, their bloody pound shop stuff anyway, can have his lights if he keeps moaning still to much to fit in their house. I am not budging on this, he gets his way to much. ffs people are now sending bills in my dads name for him cause he wont pay anyone. I think thats wrong was his solicitors after farting about pretending to be unfairly dismissed then dropped it he has fees now and wont pay. Rolling Eyes so dads getting the bills for that. he will give my dad a heart attack or something Crying or Very sad

today i am either going to chuck the lights outside for him and keep the tree if he dosnt agree or if he shuts the hell up i will hold it for him, (which is more than being nice.

and i will not be speaking to him after this i give to many chances for him to act civil. Not just this either took me a while to forgive him after telling my entire family i was a heroin addict! me against drugs and afraid of needles was called that! he got this from a movie we rented and i bought him his dinner and he had a great night at mine, he got jealous i had money and told my mum after watching veronica geran film that i had spoons everywhere and needles, explained the whole process of injecting like i was doing it. caused a massive row! admitted months later he was lying out of jealously
Twisted Evil
in that time my aunts and uncles where looking at me strange on the street and treating me like a sorry case or not speaking to me.And my mother was calling me a druggie and was upset.I had to stop several form beating the shit out of him for that.

I think he needs a wake up call and i thought living out of my parents for a few months would have helped him on his feet instead i was held against for not knowing where he was and was at??? errm why i am his sister not his mother? and the guilt trip for stopping feeding him out of my own cash.

I think he was swapped at birth there is no way thats related to any of us.

I owe him nothing,. time to be cruel to be kind again.

After my dad negotiating as bro wouldn't speak on phone all i got was mumbling and silence and the words "there mine" Then the OH got involved and i done a count of what was his, more than what i thought put it that way. Now the tree is mine and i can use whatever i like Shocked

i am only holding them till they get a shed for my parents not for him.I think they have enough stress with him never mind having this landed so they had some words. All that and its back to how it was, what the heck was that all about Question

You will need to send him a letter giving him 30 days from receipt of the letter (send recorded) to come take his belongings or they will be disposed of,
When teh 30 days are up if he hasnt been then you send another letter giving 7 days (recorded del again) at the end of this time the stuff is yours to dispose of anyway you see fit,

Some will argue that 30 days is to long considering they have been left for over a year but if it ever came down to the courts for instance, he could argue that you didnt give him enough notice that you were going to get rid,

He really thought you were ok with them being with you, you never once said other wise now did you, (your word against his) he will say he didnt have enough time to find somewhere else to put them. (hang dog look on his face here, tears in his eyes at the loss of his fairy lights)

30 days is more than enough time, the 7 days is just a final warning thats all.

Then put the bloody lot on ebay and go shop in the sales.

Do you dad a favour get hold of these, return them to the people involved with a response saying that it has nothing to do with your father and they need to take it up with your brother....
Under no circumstances let you dad give any of these any card details to pay a single penny, or they will keep taking money till they get what they are owed.

I agree there, they will keep taking from your father if he gives his card details, and if he keeps running up bills they will keep taking till your parents loose everything.

Did you read my last reply, its mine and i can use what i like now. Shocked i am suspicious of this also but dad said no one goes back on the decision after that. I didnt want my parents landed with it and he wanted to take it all down there anyway so i couldnt use any of it. So now its mine the tree as indefinite and decs, lights no i will keep them till they get a shed but only for my parents not for him. They dont need this crap. As for the bills my dads ignoring them, only the one which is solicitor has sent it in his name as he knows my dad and i think he was thinking my dad didnt know or something still out of line.

I feel so sorry for my parents i wish my brother had of turned out good because they dont deserve this they have one autistic kid thats severe and they have more than enough to deal with there and will have her for the rest of their lifes then i will when they go which is aweful to think about, i fear he will never grow up and life will hit him very very hard. the worst is yet to come for the future with him.

My OH has said he is selling some of the lights and giving my parents the money to help pay for him as he doesn't pay them anything its only right.

Thanks all for the genuine good advice you have given me. Thumbs Up Karma
